Carbon County court — drug cases

A Lehighton man is facing a prison term at the time of sentencing after he entered a guilty plea on Thursday in Carbon County court to a drug dealing charge.

He was one of nine to enter a guilty plea in drug-related cases before Judge Steven R. Serfass.

David Victor Cummings,

54, pleaded in three pending cases. He pleaded to one count of possession with intent to deliver a controlled substance and two counts of driving under the influence of a controlled substance. Another DUI charge was dropped in a plea deal with the district attorney’s office.

Cummings was arrested by Jim Thorpe police on the drug count on Nov. 8, 2018. His arrest was part of a county drug task force operation/investigation of drug dealing in the county. A vehicle stop was made and found in his vehicle was 42 oxycodone pills.

The DUI arrests occurred on April 7, 2017, and July 4, 2017, both by Lehighton police.

Serfass told Cummings he faces a minimum prison sentence, in the standard range of state sentencing guidelines, of between 27 and 33 months.

Sentencing was deferred so he can obtain a drug and alcohol evaluation relative to the DUI charges.

Other pleas

Derick John Smith,

49, of Lehighton, entered pleas in two pending cases to two counts of possession of drug paraphernalia. In exchange for the pleas the DA office dropped felony counts of possession with intent to deliver a controlled substance and criminal use of a communication facility and a misdemeanor count of possession of a controlled substance.

He was arrested on the felony counts on Sept. 25, 2018, by Lehighton police during a county drug task force investigation into drug dealing in the county. He was arrested on Oct. 24, 2017, on the possession of a controlled substance charge after police served a warrant at his residence.

On the first count he was sentenced to time-served (73 days) to six months; and on the second to time-served (77 days) to six months with the term running consecutively. He was also ordered to get a drug and alcohol evaluation and follow any recommendation for treatment.

Katie Melissa Jones,

31, of Slatington, pleaded to one count of possession of a controlled substance. She was arrested on June 13, 2019, by Weissport police following a traffic stop. She was a passenger in the vehicle.

She was placed on probation for a year and ordered to get a drug and alcohol evaluation and render 50 hours of community service.

Sherree Salome Rex,

64, of Lehighton, pleaded to one count of possession of drug paraphernalia. She was arrested on July 31, 2019, by state police at Lehighton following a traffic stop.

She was placed on probation for a year and ordered to get a drug and alcohol evaluation and render 50 hours of community service.

Gabrielle Marie Sadusky,

21, of Tamaqua, pleaded to one count of possession of a small amount of marijuana. She was arrested n May 11, 2019, by state police at Lehighton, following a traffic stop.

She was fined $300.

William Lasso,

56, of Palmerton, pleaded to one count of possession of a small amount of marijuana. He was arrested on Sept. 4, 2019, by state police at Lehighton following a traffic stop.

He was fined $300.

Jacqueline Marie Dolly,

25, of Nesquehoning, pleaded to one count of possession of drug paraphernalia. She was arrested on April 27 by Nesquehoning police.

She was placed on probation for a year and ordered to get a drug and alcohol evaluation and render 50 hours of community service.

Jessica Nicole Warner,

26, of Kunkletown, pleaded to one count of possession of drug paraphernalia. A charge of possession of a controlled substance was dropped in a plea deal.

She was arrested on Dec. 5, 2019, by Jim Thorpe police at the courthouse where she was found with drugs after reporting for a required urine test.

She was placed on probation for a year and ordered to get a drug and alcohol evaluation and render 50 hours of community service.

Joshua P. Hansen,

37, of Kunkletown, pleaded to one count of possession of drug paraphernalia. A charge of possession of a controlled substance was dropped in a plea deal.

He was arrested on Oct. 17, 2019, by state police at Lehighton, following a traffic stop. He was a passenger in the vehicle.

He was placed on probation for a year and ordered to get a drug and alcohol evaluation and render 50 hours of community service.

Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
