Carbon County court — DUI

Two defendants in driving under the influence cases who previously entered guilty pleas were sentenced Tuesday in Carbon County court.

President Judge Roger N. Nanovic II imposed sentences on:

Jeffrey R. Kistler,

35, of Andreas, was sentenced to serve six months to five years in jail, pay a fine of $1,500, his license was suspended for 18 months and he must supply a DNA sample.

He was arrested on Jan. 20, 2017, by Mahoning Township police along Route 443. He refused a test.

He was given credit for 67 days spent in an inpatient rehabilitation program and jail. He will begin serving the remainder of his term at 3 p.m. on June 5 and serve it on consecutive two-day weekends.

Paul Niedzialek,

27, of Nesquehoning, was placed on probation for six months and ordered to pay a fine of $300.

He was arrested on Oct. 20, 2017, along Route 209 by Nesquehoning police. A test revealed a 0.08 BAC.

Nanovic noted Niedzialek spent time in prison because he kept failing to get the required drug and alcohol evaluation and comprehensive test.

Both defendants must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole/probation.
