Carbon man admits to harassment of a corrections officer

A Carbon County man pleaded guilty in the county court on Monday morning to three criminal counts, including aggravated harassment by a prisoner of a corrections officer.

William J. Moyer, 40, of Lehighton, pleaded to the harassment count, which is a felony 3, and two counts of retail theft, both theft incidents occurring at the Walmart store in Mahoning Township.

Moyer was arrested by Nesquehoning police on Aug. 18, 2018, when officers were called to the county prison for an assault incident. Through an investigation police learned that Moyer failed to follow instructions of correctional officers to return to his cell. He then spit in the face of one of the officers. It was noted that Moyer was on suicide watch at the time.

Defense attorney Paul J. Levy, of the public defender’s office, told the court his client was in poor mental state at the time and was the reason he was on suicide watch. He said his actions against the officers was due in part to that condition.

Moyer said he has since apologized to the correction officers for his actions.

Moyer was arrested for the Walmart incidents on May 22 and June 20, 2019.

On the assault count Nanovic sentenced him to time-served (211 days) to one day less 24 months. On the retail theft charges he was placed on probation for a year on each count, with all the terms running concurrently.

Moyer was also ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance for drug or alcohol use, supply a DNA sample, make restitution to Walmart for $1,052, pay court costs of about $1,000 and pay a $50 per month supervision fee while on parole.
