Christy gets state time for Schuylkill offenses; has outburst in courtroom

Shawn Christy had his day in court — most likely his final day in Schuylkill County court — and he ended it with a violent outburst against the judge, and the general population of the courtroom.

“(Expletive) you!, (Expletive) you!” Christy shouted at Schuylkill County Judge Cyrus Palmer Dolbin. Dolbin directed County Sheriff’s Deputies to remove Christy, and Deputy Jack Buchinsky put a firm hand around the leather strap across Christy’s back, which connected to his handcuffs. Buchinsky led Christy from the table, where he was flanked by Deputy Keith Berezwick and Captain Scott Taylor. As he was being escorted out, Christy twisted around between them to shout into the courtroom, “(expletive) you!” about a dozen times.

In late October, a Schuylkill County jury found Christy guilty of simple assault and harassment, and not guilty of aggravated assault. Christy was in court for sentencing; Dolbin sentenced him to serve 12 to 24 months in state prison, with 336 days credit for time served.

The charges stemmed from a March 2017 fight between Christy and former McAdoo Mayor Stephan Holly. The incident was captured on video outside McAdoo borough hall; Christy swung a stick at Holly during an argument about snow removal.

The October trial was prosecuted by Berks County Assistant District Attorney Jordan Fegley. Schuylkill County District Attorney Mike O’Pake could not prosecute because he had served as Christy’s public defender at that time.

During the sentencing, Fegley said that six to 12 months would be the standard sentence for simple assault, but because of the use of a weapon he asked for 12 to 24 months.

Dolbin asked Christy, who has represented himself at legal proceedings at the county and federal level, if he had anything to say. Christy began to read from pages he had prepared. As he did at his trial, he claimed that the video had been altered and that he had not been allowed “due process” to obtain an original copy of the video.

He also claimed a criminal conspiracy against him, naming O’Pake, Schuylkill County Judges Jacqueline Russell and John Domalakes, federal agents, Pennsylvania State Police and others. After Christy had read from his documents for several minutes, Dolbin interrupted him.

“How many more pages do you have?” Dolbin asked.

“Ten,” Christy replied.

Dolbin then said that the court would not hear any further recitation from Christy, stating that the information was “not relevant to the sentencing.” Christy argued the matter, and began to shout, visibly shaking. Dolbin cautioned him to lower his voice and warned him that he’d be removed from the room. Christy’s response was to start cursing, and he was removed.

“The defendant has clearly disrupted these proceedings,” Dolbin said.

Federal sentence pending

Christy had gone on the run during the summer of 2018, after he failed to appear for trial on the charges from the McAdoo incident. U.S. marshals, local and state police cooperated on a multistate manhunt, capturing Christy in Ohio.

In late November, jurors found Christy guilty on all counts in his federal trial stemming from the 95-day manhunt. The 11 charges included threats against the president, threatening communications, interstate transportation of a stolen vehicle, interstate transport of stolen firearm, possessing a firearm while facing a felony charge, and being a fugitive in possession of a firearm.

Jurors also found Christy guilty on a final, twelfth count — being a known felon in possession of a firearm — a short time later. Judge Robert Mariani wanted that count tried separately because it required telling the jury that Christy had previously been convicted of a felony.

Christy’s sentencing from the federal trial is slated for February 2020. During the Schuylkill County sentencing hearing, Fegley said that Christy has an additional case pending in Schuylkill County, but that would be continued to the March 2020 trial term, until after the federal sentencing.

“We will probably Nol Pros (not prosecute) the other case,” Fegley said. “And we won’t be back.”
