Carbon County court

A Carbon County man was sentenced on Thursday morning by Judge Steven R. Serfass in four criminal cases including driving under the influence and drug counts.

Lehighton incidents

David Fury II

, 31, of Jim Thorpe, was sentenced to a total of 108 days to 60 months on two counts of DUI and one count each of possession of a controlled substance, heroin, and possession of drug paraphernalia. On a summary motor vehicle code violation, he was fined $25 and costs.

Fury was arrested on the first DUI on Dec. 3, 2015, on North Street in Lehighton by state police at Lehighton. The second DUI arrest was on Feb. 27, 2016, on Second Street in Lehighton by borough police. Both DUIs were controlled substances. The drug arrest occurred on Feb. 2, 2017, by Lehighton police in the 400 block of North Second Street. The summary offense occurred on Feb. 4 along Bridge Street in Lehighton filed by state police at Lehighton. In that case, three counts of DUI were dropped in a plea bargain with the district attorney’s office.

Serfass sentenced him to serve 72 hours to six months on the first DUI, pay a fine of $1,000 and one-year license suspension, with credit for two days served; on the second DUI, time-served (108 days) to 60 months, a fine of $1,500 and 18-month license suspension; on the drug counts time-served (five days) to six months consecutive to the DUIs. He must also pay court costs, a supervision fee while on parole and do 150 hours of community service. The DUI counts run concurrent.

Fury is an inmate in the county prison and will now be paroled.

Other case

Aquiles V. Conde Shenery

, 34, of Hazleton, was sentenced on two summary counts of stop signs and illegal park to pay a total of $75 in fines and costs.

Shenery is currently an inmate at the state correctional institution at Erie serving a sentence imposed in another county.
