Jury finds Schuylkill doctor not negligent

A Schuylkill County jury found no negligence by the doctor in a civil trial that concluded Thursday.

The civil lawsuit had charged the doctor with professional negligence – wrongful death, and sought monetary damages outside arbitration limits.

Mark V. Caliendo performed an ultrasound guided thyroid biopsy on patient Joann Mays, Pottsville, on Sept. 8, 2015. The procedure was done at Affiliated Interventional Services, New Philadelphia.

On the evening following her surgery, Mays began to have trouble breathing and was later transported by helicopter to Lehigh Valley Hospital, Allentown. Surgeons there found active bleeding from the right superior thyroidal artery and Mays suffered an hypoxic brain injury.

A week later, Mays passed away Sept. 18.

The trial began Monday, and lawyers presented closing arguments Thursday morning. President Judge William E. Baldwin presided over the trial. Attorney Fred Fanelli represented the Mays estate, while attorney Michael Badowski represented Caliendo. Caliendo has been practicing at the New Philadelphia location since 2001.

Neither attorney responded to phone messages requesting comment on the case.

Much of the testimony involved debate over types of procedures used for thyroid biopsies.
