Carbon County court – guilty pleas

A Lehighton man admitted to an assault charge in Thursday afternoon in Carbon County court.

He was one of four defendants in pending criminal cases to enter a guilty plea before President Judge Roger N. Nanovic II.

Lehighton incident

Henry J. Tomasko III

, 42, pleaded to one count of simple assault with a charge of indecent assault dropped in a plea bargain with the district attorney’s office. Both counts are misdemeanors.

Tomasko was charged for an incident on Jan. 30 outside the New Hope Drop In Center along North Street. Borough police said Tomasko and a woman were standing outside the center when he touched the women’s breasts.

The woman testified that she has received counseling since the incident because it has affected her life. Assistant District Attorney Seth Miller also told the court that his office received complaints that Tomasko is “hanging around” the drop-in center, which has traumatized the victim.

Tomasko apologized for his actions and said he has mental health issues, for which he is now on medication. He claimed he was off his medication on the day of the incident.

Nanovic placed him on probation for a year and ordered he get both drug and alcohol and mental health evaluations and follow any recommendations for treatment, to stay away from the drop-in center, pay restitution of $25 and have no contact with the victim.
