Carbon County court – ARD

Nineteen first-time offenders in the criminal justice system were placed on Tuesday in Carbon County’s Accelerated Rehabilitation Disposition probation program by Judge Steven R. Serfass.

If a person successfully completes all conditions of the program their record his wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.

All were placed for a year, unless otherwise noted, on driving under the influence charges and related offenses.

Nicholas Richard Brann

, 33, of Kunkletown, was arrested on Sept. 3, 2018, by state police at Lehighton along Church Street in Towamensing Township. A test revealed the presence of a controlled substance.

He was assessed $600 for the cost of the program and his license was suspended for 60 days.

Daniella C. Carite

, 33, of Ashley, Luzerne County, was arrested on Dec. 9, 2018, by Palmerton police along Delaware Avenue. A test revealed the presence of a controlled substance.

She was assessed $600 and her license was suspended for 60 days.

Joshua Christopher Conner

, 222, of West Chester, Ohio, was arrested on March 16, 2018, by state police at Fern Ridge along Interstate 80 in Kidder Township. He refused a test.

He was assessed $600 and license suspended for 60 days.

Carl Cressley

, 44, of Lehighton, was arrested on Oct. 19, 2018, along Iron Street by Lehighton police. He refused a test.

He was assessed $600 and his license was suspended for 60 days.

Nathan David Eckhart

, 22, of Palmerton, was arrested on July 28, 2018, by state police at Lehighton along Forest Inn Road in Towamensing Township. A test revealed a 0.19 BAC.

He was assessed $650 and his license was suspended for 60 days.

Lewis D. Exner Sr.

, 76, of Andreas, was arrested on Oct. 11, 2018, by Lehighton police along Mahoning Street. A test revealed a 0.16 BAC.

He was assessed $600 and his license was suspended for 60 days.

Tyler J. Fisher

, 20, of Weissport, was placed for 18 months. He arrested on Dec. 2, 2018, by Franklin Township police along Canal Road. A test revealed the presence of a controlled substance.

He was assessed $600 and his license was suspended for 90 days and he must render 75 hours of community service.

Mary Goodhile

, 51, of Summit Hill, was arrested on May 5, 2018, by Summit Hill police along Ridge Street. A test revealed a 0.30 BAC.

She was assessed $650 and her license was suspended for 60 days.

Nicholas A. Koma

, 21, of Palmerton, was arrested on July 18, 2018, along Third Street by Palmerton police. He refused a test.

He was assessed $600 and his license was suspended for 60 days.

Kendall Joy Lawless

, 19, of White Haven, was arrested on Nov. 5, 2018, by Weatherly police along Main Street. A test revealed a 0.04 BAC.

She was assessed $450 and her license was suspended for 90 days.

Thomas A. McWhinney

, 67, of Lehighton, was arrested on Dec. 31, 2018, by state police at Lehighton along Long Run Road in Franklin Township. A test revealed a 0.20 BAC.

He was assessed $550 and his license was suspended for 60 days.

Matthew Nothstein

, 33, of Andreas, was arrested on Dec. 14, 2018, by Lehighton police along Route 443. A test revealed the presence of a controlled substance.

He was assessed $600 and his license was suspended for 60 days.

Leanne F. Penkala

, 73, of Lake Harmony, was arrested on Dec. 14, 2018, by state police at Fern Ridge along Lake Harmony Road in Kidder Township. She refused a test.

She was assessed $600, her license was suspended for 60 days and she must render 50 hours of community service.

Michael Charles Penso

, 59, of Allentown, was arrested on Feb. 26, 2018, by state police at Lehighton along Route 209 in Franklin Township. A test revealed the presence of a controlled substance.

He was assessed $600 and his license was suspended for 60 days.

Michael Thomas Perno

, 55, of Summit Hill, was arrested on Nov. 2, 2018, by Summit Hill police along Ludlow Street. He refused a test.

He was assessed $600 and his license was suspended for 60 days.

Jay Tyler Rambo

, 52, of Lehighton, was arrested on Nov. 18, 2018, by state police at Lehighton along Lizard Creek Road in East Penn Township after being involved in a crash.

He was assessed $650 and his license was suspended for 60 days.

John Axl Rose

, 24, of Blakeslee, was arrested on Jan. 12 by state police at Fern Ridge along Route 903 in Penn Forest Township. A test revealed a 0.15 BAC.

He was assessed $500 and his license was suspended for 30 days.

Evin Anthony Rumbalski

, 19, of Germansville, Lehigh County, was arrested on March 12, 2018, along Route 443 by Lehighton police. A test revealed the presence of a controlled substance.

He was assessed $650 and his license was suspended for 90 days.

James Cornelius Simmons

, 56, of Lehighton, was arrested on Jan. 27, 2017, by Franklin Township police along Route 2015. A test revealed the presence of a controlled substance.

He was assessed $600 and his license was suspended for 60 days.

All were also ordered to render 50 hours of community service, unless otherwise noted. pay court costs of about $1,000, pay a $50 per month supervision fee while in the program and follow any recommendation of their drug and alcohol evaluation.
