Another party in the ongoing dispute over a firm’s proposal to build wind turbines in Carbon County has filed a legal notice in the county court that it is joining in the actions against the proposal.

Penn Forest Township, by its solicitor Thomas S. Nanovic, filed a “notice of intervention” on Tuesday. The notice states, “Please take notice that Penn Forest Township, a township of the second class, and the township in which the property which is the subject of this zoning appeal is located, intervenes in this appeal in support of the Appellee, the Zoning Hearing Board of Penn Forest Township.”

The Bethlehem Authority, on whose land the construction of 28 nearly 600-foot-tall wind turbines would be built, also filed a notice of appeal of the decision of the Penn Forest Zoning Hearing board denial of Atlantic Wind’s second special exception permit application.

The township is supporting its zoning board in defending its decision to deny a special exception permit. Atlantic Wind claims the Penn Forest Zoning Hearing Board “abused its discretion” when it denied its second special exception permit application in December. Atlantic Wind filed its appeal with the county court on Feb. 28.
