Weatherly man is custody after firing gunshots during dispute

A Weatherly man has been charged after he fired gunshots in the direction of another person during a dispute.

According to an affidavit of probable cause filed by Pennsylvania state trooper Michael King-Comerford:

At 3:49 p.m. Sunday, King-Comerford was dispatched to a home along Buck Mountain Road, Lausanne Township, in response to a neighbor dispute.

King-Comerford talked to the victim, who said that Dwaine Solana, 42, arrived at the residence driving a black 1995 Ford F-150.

The victim said Solana was highly intoxicated, extremely agitated and confrontational.

Solana confronted the victim and threw a plastic container of chicken salad at the victim’s truck.

As Solana turned, the victim saw a black firearm in Solana’s right hand and approached him in an aggressive manner.

The victim told Solana to secure his firearm and leave. Solana failed to comply.

As Solana continued toward the victim, the victim discharged one round in the air.

Solana ejected one live round from his firearm and discharged three rounds in the direction of the victim. Solana retreated to his vehicle and discharged an additional round in the direction of the victim.

The one live Blazer Brass 9 mm Luger round and three spent Blazer Brass 9 mm Luger casings were located on scene.

While conducting interviews, King-Comerford observed Solana’s vehicle traveling west on Buck Mountain Road.

King-Comerford returned to his patrol vehicle and positioned himself directly behind Solana’s vehicle and conducted a traffic stop in the driveway of Solana’s residence along Buck Mountain Road.

King-Comerford saw Solana seated in the front driver seat, and immediately detected a strong odor of alcoholic beverage. Solana had bloodshot, glassy eyes, and he was instructed to get out of the vehicle.

A Taurus G2 TXS3307 semi-automatic handgun was on the front passenger seat, partially obscured beneath a plastic bag, and a spent Blazer Brass 9 mm Luger casing was on the front passenger seat.

Solana was transported to Lehigh Valley Hospital — Hazleton, for a legal blood draw, which he refused.

Solana faces charges of aggravated assault; driving under the influence of alcohol or controlled substance; terroristic threats; simple assault; recklessly endangering another person; harassment; careless driving; and occupant protection.

He is currently incarcerated in the Carbon County Correctional Facility in lieu of $75,000 bail, and scheduled to have a preliminary hearing at 10:45 a.m. March 6 before District Judge Eric M. Schrantz of Jim Thorpe.
