Carbon County court — ARD

Seven first-time offenders were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program on Friday by Judge Joseph J. Matika.

If a person successfully completes all conditions of the program their record is wiped clean. If they fail to complete it, or are revoked from it, they would then face trial on all pending charges. A person does not admit guilt in entering the program.

All were placed for a year.

Ana Maria Belette

, 27, of Hazleton, was placed on a charge of violations concerning licenses. She was arrested on July 31 along Interstate 80 in East Side Borough by state police at Fern Ridge following a vehicle stop.

She was assessed $450 for the cost of the program and ordered to render 50 hours of community service.

Nick James Berkheimer

, 24, of West Hazleton, was placed on a charge of driving under the influence. He was arrested on July 22 by state police at Hazleton along Chestnut Street in Banks Township. A test revealed a 0.17 BAC.

He was assessed $550 and ordered to render 50 hours of community service, and his license was suspended for 60 days.

Shelley J. Kalins-Lutz

, 49, of Lake Harmony, was placed on a charge of confined within premises of the owner, a dog law violation. She was arrested on June 3 by dog law enforcement for letting her dogs run unleashed in the area of Quail Run Road in Kidder Township.

She was assessed $650 and ordered to render 50 hours of community service and keep her dogs confined as required by law.

Rashon Khalil Nelson

, 22, of Philadelphia, was placed on a DUI charge. He was arrested on April 21 along I-80 in Kidder Township by state police at Fern Ridge. A test revealed the presence of a controlled substance.

He was assessed $600 and ordered to render 50 hours of community service and his license was suspended for 60 days.

Jason John Noonan

, 44, of Cody, Wyoming, was placed on a DUI charge. He was arrested on May 8 along I-80 in Kidder Township by state police at Fern Ridge. A test revealed a 0.14 BAC.

He was assessed $500 and ordered to render 50 hours of community service, and his license was suspended for 30 days.

Jessica Torres

, 32, of Lehighton, was placed on a charge of retail theft. She was arrested on June 25 by Mahoning Township police at the Walmart store.

She was assessed $450 and ordered to render 50 hours of community service, make restitution to Walmart for $231.08, which is her share as there is a co-defendant in the case, and stay out of the store during the ARD placement period.

Breeauna Michelle Yesthal

, 20, of Andover Township, New Jersey, was placed on a DUI charge. She was arrested on April 9 along Route 534 at Hickory Run State Park by park rangers. A test revealed the presence of a controlled substance.

She was assessed $600 and ordered to render 50 hours of community service and her license was suspended for 90 days.

Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee while in the program, and those charged with DUI must follow any recommendation of their drug and alcohol evaluation.
