New York state man is on trial for sexual assault of young girl

A New York state man went on trial Tuesday in Carbon County court charges with raping a young girl from White Haven.

Frederick Clinton Kimball Jr., 52, of Tannersville, is charged with 16 counts of charges stemming from incidents that allegedly occurred back in 2008-2011 time frame. He is charged with two counts each of rape of a child, sexual assault, aggravated sexual assault of person less than 16, indecent assault and indecent exposure; and three counts each of photograph/film on computer of sex acts with child and corruption of a minor.TestimonyThe victim, now 21, testified that Kimball raped her three times over a four-year period at her then trailer home in the Springfield Mobile Park in White Haven, near Weatherly. She said she was between the ages of 12 to 13. She said the incidents occurred in a camper the defendant had set up near her trailer home, in the bed of her mother in the trailer home and in the defendant's pickup.She testified that shetold her mother the same day. "She didn't believe me," the victim said.She also said Kimball threatened her family if she did not submit to him."He told me not to all anybody," the victim told the jury.She said the second assault occurred in her mother's bed in the trailer home. She said she again told her mother but again her mother didn't believe her.The third assault occurred in Kimball's pickup. He said he would take her to a store but stopped and made her get in the back of the truck and he raped her again.Under questioning by court-appointed defense attorney Michael Gough, the girl said she didn't remember being interviewed by the Carbon County Office of Children & Youth and couldn't remember the dates of the assaults.Questioned about the assault in her mother's bed, she testified she didn't remember if her mother was in a bathroom, located next to the bedroom, or was out of the home.The first witness was the victim's mother, who said she met Kimball on a website. She communicated on the site with him and they finally met at her home in April 2006.She testified she got pregnant by Kimball but lost the child due to a miscarriage. She said the sexual relationship lasted about two or three months.She said their relationship changed in 2008 when her daughter told her about the incidents with Kimball. She admitted she did not believe her daughter at first but then felt something had happened.She eventually ended the relationship with Kimball.She also claimed that Kimball told her he was a member of a gang called Black Hawks and the Mafia.He told her there were cameras and recording devices in her home and that "people were watching her from the woods."Trooper Donald Marsh, of the Hazleton barracks and prosecuting officer, testified he first became involved in the investigation in February 2012 when he received information from the Office of Children and Youth. He said he interviewed the victim, with a member of the children and youth staff, in February 2012. He said because the alleged acts occurred months prior there was no way to get any physical evidence or DNA samples.He said there were some inconsistencies in the victim's statement but the basic facts were always the same.He said he did not interview the defendant personally. He said that interview was videotaped and he viewed it. In the interview Kimball denied any sexual contact with the victim.WitnessesHe also was questioned about a female named "Jodi." During the testimony of the mother, she mentioned that she received an email from a Jodi who she said Kimball identified as a longtime friend. She said in some of the emails from Jodi, she urged her to let Kimball be "the first" for her daughter. She rejected that idea, so did Kimball.Marsh said he attempted to find Jodi after learning her last name and that of her husband, but could never find the person. He admitted it was a difficult search because he had no ages or birth dates.The mother testified that later on Kimball told her that Jodi had died.The victim's grandmother was questioned about some of the entries in her dairy about Kimball and his relationship with her daughter, the victim's mother.Kimball took the witness stand late Tuesday afternoon, but President Judge Roger N. Nanovic II stopped the testimony about 4:30 p.m.The trial resumed at 9 a.m. today with Kimball continuing his testimony.Kimball is an inmate in the county prison. He was convicted in New York state of similar crimes and is currently serving a 20-year sentence.
