Man who exposed self to teen gets jail

A Lansford man who previously admitted exposing himself to a teenage girl and performing a sex act in front of her, was sentenced to a prison term on Monday in Carbon County court.

Richard Thomas Ogozalek, 54, was sentenced by President Judge Roger N. Nanovic II to serve 3 to 18 months in the county prison on a charge of indecent exposure followed by 2 years of probation. On a charge of open lewdness he was placed on probation for a year, concurrent with the first count.Lansford police charged that on June 30, 2016, at a residence along East Patterson Street, Ogozalek exposed himself to a then 13-year-old girl. Police also said he performed a sex act in front of the girl. The incident was reported by the victim's mother on July 2, 2016.Defense Attorney Paul Levy, of the public defender's office, said Ogozalek's actions were the result of alcohol and drug abuse. He said he went into an inpatient rehabilitation program from March 3 to April 14 for his addiction problem.Ogozalek told Nanovic, "I never thought I do something like that. I can't believe it." He blamed his drug abuse stating he was using methamphetamine at the time.He said he went to intensive outpatient counseling sessions and continues counseling sessions. He added, "I was brought up in a good family."Nanovic said he didn't believe the methamphetamine and alcohol caused him to do what he did. He told Ogozalek, "You continued to use meth after being charged."Nanovic also ordered Ogozalek to get both drug and alcohol and mental health evaluations, make restitution of $400 to the victim's assistance program, continue attending AA meetings, submit to a sexual offenders evaluation, zero tolerance for drug and alcohol use, have no unsupervised contact with anyone under 18, pay court costs of about $1,000 and pay a $50 per month supervision fee when released on parole. He was also given credit for the time spent in the rehab program.After the sentence was imposed Ogozalek asked if he could serve the time on house arrest. Nanovic said he would consider that if Levy spoke to the adult probation office to see if Ogozalek is eligible for the program and if he is, then submit a petition to the court to consider the placement in the Intermediate Punishment Program.The jail term will begin at 6 p.m. on July 28.
