Carbon County court - ARD

First-time offenders in the criminal justice system were placed in Carbon County's Accelerated Rehabilitation Disposition probation program by Judge Steven R. Serfass.

If a person successfully completes all conditions of the program their record his wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.

All were placed for a year, unless otherwise noted.

Brian William Bachman, 47, of Lehighton, was placed on a driving under the influence charge. He was arrested on Nov. 18, 2016, along Fireline Road in Lower Towamensing Township by state police at Lehighton. A test revealed a 0.12 BAC.

He was assessed $500 for the cost of the program and ordered to render 50 hours of community service and his license was suspended for 30 days.

Chad Kyle Berger, 25, of Lehighton, was placed for two years on a charge of aggravated assault. He was arrested on July 22, 2016, by Lehighton police for an incident at the Blue Mountain Health Systems Lehighton Campus. He assaulted a nurse at the hospital who was attempting to draw blood from him. Before placing him in the program Serfass said he spoke with the attorneys involved because of his concerns in the matter. He said he was told that the victim agreed to the ARD placement. Serfass said based on the victim's approval he would go along with it.

He assessed Berger $650 and ordered he get a drug and alcohol evaluation, zero tolerance for drug and alcohol use, render 100 hours of community service and have no contact with the victim.

Jacob Isaiah Haydt, 21, of Allentown, was placed on a DUI charge. He was arrested on May 20, 2016, by Lehighton police along Ninth Street. A test revealed the presence of a controlled substance.

He was assessed $600 and ordered to render 50 hours of community service and his license was suspended for 60 days.

Craig Steven Hunsicker, 40, of Wilkes-Barre, was placed on a charge of forgery. He was charged by Jim Thorpe police.

He was assessed $450 and ordered to render 50 hours of community service. It was noted there was a restitution figure but it has already been paid.

Joseph T. Igielski, 41, of Philadelphia, was placed on a DUI charge. He was arrested on Jan. 25 along Lehigh Avenue by Jim Thorpe police. A test revealed the presence of a controlled substance.

He was assessed $600 and ordered to render 50 hours of community service and his license was suspended for 60 days.

Christina Marie Obrecht, 31, of Palmerton, was placed on a DUI charge. She was arrested on Sept. 5, 2016, along Second Street by Palmerton police. A test revealed a 0.13 BAC.

She was assessed $500 and ordered to render 50 hours of community service and her license was suspended for 60 days.

Carl Robert Pugliese, 22, of Moosic, Lackawanna County, was placed on a DUI charge. He was arrested on Dec. 22, 2016, along the turnpike in Penn Forest Township by state police at Pocono after being involved in a crash.

He was assessed $600 and ordered to render 50 hours of community service and his license was suspended for 60 days.

Alcenie Rodriguez, 25, of Allentown, was placed on a DUI charge. He was arrested on Sept. 3, 2016, by state police at Lehighton along Route 209 in Towamensing Township. A test revealed the presence of a controlled substance.

He was assessed $600 and ordered to render 50 hours of community service and his license was suspended for 60 days.

William David Shook III, 19, of Lehighton, was placed on a charge of possession with intent to deliver a controlled substance - marijuana. He was arrested on Aug. 4, 2015, by state police vice unit of the Hazleton barracks in the Parryville Park. He sold to a confidential informant.

Serfass said he was approving the placement after speaking with the attorneys involved.

Shook was assessed $450 and ordered to render 100 hours of community service, get a drug and alcohol evaluation and zero tolerance for drug and alcohol use.

Samantha Kimberly Snyder, 25, of Tamaqua, was placed on a DUI charge. She was arrested on Oct. 20, 2016, along Mahoning Street by Lehighton police. A test revealed a 0.15 BAC.

She was assessed $550 and ordered to render 50 hours of community service and her license was suspended for 60 days.

Kyle William Tobias, 30, of Albrightsville, was placed on a DUI charge. He was arrested on Dec. 17, 2016, along Old Stage Road in Penn Forest Township by state police at Fern Ridge. A test revealed a 0.20 BAC.

He was assessed $550 and ordered to render 50 hours of community service and his license was suspended for 60 days.

Dakota James Wentz, 21, of Walnutport, was placed on a DUI charge. He was arrested on Nov. 26, 2016, by state police at Lehighton along Bridge Street in Weissport. A test revealed the presence of a controlled substance.

He was assessed $600 and ordered to render 50 hours of community service and his license was suspended for 90 days.

Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee while in the program and those charged with DUI, follow all recommendations of their drug and alcohol evaluation.
