Pike County man gets DUI with child in car

A Pike County man was sentenced to a state prison term on Thursday in Carbon County court on charges of driving under the influence of a controlled substance and endangering the welfare of a child - driving drunk with a child in the car.

Nicholas Joseph Munoz, 27, of Matamoras, was sentenced by Judge Joseph J. Matika to serve one to two years in a state correction institution on the endangering count and six to 12 months on the DUI charge. The terms run concurrently.Munoz and his wife, Chelsea Munoz, 24, who listed an Andreas address, were arrested on Aug. 21, 2015, along Blakeslee Boulevard Drive East by Mahoning Township police following a short chase and traffic stop.Nicholas Munoz was found to be operating the vehicle under the influence of a controlled substance with an infant found in the vehicle.Also with him was his wife, Chelsea, who pleaded to one count of carrying firearms without a license. A handgun was found in the vehicle.Nicholas Munoz was originally charged with 10 criminal counts. Counts of firearms not to be carried without a license, possession of a prohibited offensive weapon and two drug counts were dropped in a plea agreement. The sentencing of Chelsea Munoz is scheduled for July 3.Munoz admitted to a drug addiction problem. He has a long prior criminal record.It was noted that he was recently sentenced in Monroe County to serve six to 12 years in a state prison after he was found guilty by a jury of drug and related charges.Matika ordered him to pay a $1,500 fine on the DUI charge and suspended his license for 18 months. He was also ordered to get a drug and alcohol evaluation and follow any recommendations for treatment, supply a DNA sample, pay court costs of about $1,000 and render 100 hours of community service when released on parole.Matika ruled the term would run concurrent with the Monroe County sentence he is currently serving.
