A Luzerne County firm and two of its officers were fined $50,000 and faces a big restitution bill after entering guilty pleas in Carbon County court on Monday to violating state environmental regulations.

Hazleton Oil & Environmental Inc. and officers Daniel Ryan Clemens, 33, of Harleysville, and John Scott Clemens, 60, of Hazleton, appeared before Judge Joseph J. Matika on charges filed by the state Attorney General's office. The violations occurred at an address in Banks Township and one in Barnesville, Schuylkill County.Daniel Clemens pleaded to four counts of unlawful conduct. The firm, through John Clemens, pleaded to tampering with public records and two counts of unlawful conduct. In a plea bargain John Clemens was placed in the county's Accelerated Rehabilitation Disposition probation program.The state Department of Environment Protection accused the defendants of accepting waste oil in amounts not allowed by statute, recycling waste oil with regular oil and delivering it and doctoring records. The DEP said the actions occurred over the time period of May 2010 to June 2012. Daniel Clemens was accused of being involved in 35 instances of illegal acts in one case including disposal of waste over the limit provided by DEP.Matika accepted a plea bargain in which the fine of $50,000 was imposed against the firm - $25,000 each of two counts - and a restitution of $62,707 to DEP.Daniel Clemens was placed on probation for a total of three years, also fined a total of $4,000 and ordered to render a total of 150 hours of community service. The fines and restitution will be paid in full in 26 monthly payments.John Clemens was placed in the ARD program for six months and ordered to pay an assessment fee of $650 and render 25 hours of community service.Each defendant must also pay court costs of about $1,000 and the two Clemenses pay a $50 per month supervision fee while on probation.
