Woman shot by hunter files suit in Carbon

Awoman who was shot by a hunter who said he thought he was shooting at a coyote on State Game Lands, has filed a civil suit in Carbon County Court.

She is seeking damages in excess of $50,000, plus interest and cost. A jury trial is demanded.Sharon Krause of 184 Ashley Lane, Lehighton, filed the action against Michael J. Harvan, 58 Floral Lane, Lehighton, alleging negligence in the incident that happened on Nov. 22, 2015, on State Games Lands, Area 217, Carbon County.The complaint states Krause accompanied her boyfriend, Edgar Radowitch, to the property when suddenly and without warning, she was struck by a bullet from a .22-250-caliber hunting rifle that was discharged by Harvan. The complaint states Harvan "suggested that he had mistaken the plaintiff for a coyote and that he would have shot again had the plaintiff not screamed."The plaintiff claims, among other things, that Harvan did not have a clear view of Krause when he pulled the trigger, and that he disregarded the substantial risk of harm posed by aiming a gun without first confirming that there were no people in his line of sight.As a result of the shooting, Krause contends she sustained serious injuries, suffers from physical pain, is unable to pursue and enjoy the usual activities of an individual of her age, and that she has had to expend great sums of money for medical care and treatment, medication and therapy and rehabilitation.She also alleges to suffer great mental anguish, physical pain, disfigurement and humiliation and asks a jury of 12 to determine her cause.
