Two Northampton County brothers admitted on Tuesday in Carbon County court to stealing various items from the Walmart store in Mahoning Township.
One was immediately sentenced to a state prison term while the second had his sentencing delayed. Both have prior criminal records.Jason Scott Burd, 31, and Joshua Matthew Burd, 33, both of Bath, pleaded to one count of criminal conspiracy - retail theft.The two were arrested on Jan. 2 by Mahoning Township police after they filled a shopping cart with various items and then pushed it out of the store without paying for the items. Video surveillance showed the two leaving the store with the cart.Jason Burd is currently an inmate in the state correctional institution at Mahanoy, Schuylkill County, facing a state parole revocation proceeding.Judge Joseph J. Matika, who accepted the pleas, sentenced him to serve nine to 24 months in a state prison. He was also ordered to get a drug and alcohol evaluation, zero tolerance for drug and alcohol use, supply a DNA sample, render 50 hours of community service when released on parole, make restitution of $369.94 to Walmart, one-half the total due, and pay court costs of about $1,000.The sentencing for Joshua Burd was deferred as Matika ordered the adult probation office to prepare a presentence investigation report. It was noted Joshua Burd has charges pending in Lehigh County.
