A Jim Thorpe man is in hot water after he resisted arrest after a heavy night of drinking.

Brian Jay Ohl Jr., 21, of Winter Green Lane, faces charges of driving under the influence, resisting arrest and other motor vehicle violations for an incident in Nesquehoning.According to the affidavit, on June 11, Nesquehoning patrolman Carl Breiner received a report of a vehicle parked illegally and blocking the roadway on Holland Street, between Railroad and Catawissa streets.Breiner found the silver Nissan on the left side of the road with its driver's side tires in a private yard and the passenger side tires sticking out into the roadway.A man who appeared to be sleeping was observed in the driver's seat and an open can of beer was in the console with the keys still in the vehicle's ignition.Breiner opened the passenger door and removed the keys and beer and then attempted to wake the driver unsuccessfully.After several attempts, Ohl woke up, looked and Breiner and shrugged, smiled and put his head back down.Breiner again asked Ohl several times to wake up. Ohl finally complied, again smirking before putting his head back down. This time Breiner noticed Ohl's eyes were bloodshot.Police again attempted to get Ohl up, but Ohl braced himself with his feet against the floor and held onto the steering wheel. A struggle began and Ohl continued to resist as officers threatened to pepper spray him.Ohl looked at officers and smiled, saying "come on, guys." He was then pepper sprayed.Ohl continued to struggle and kick as officers finally removed him from the vehicle. Once outside, Ohl complied and was treated for the pepper spray.He admitted to drinking heavily before begin taken to a hospital for a blood test.He was then transported home and released.Ohl's BAC was 0.142. He faces a preliminary hearing before District Judge Casimir Kosciolek at 2:30 p.m. Sept. 28.
