Carbon man gets prison for corruption of a minor

A Carbon County man was sentenced to a state prison term Thursday on two counts of corruption of a minor.

John Klingaman, 39, formerly of 12 E. Hazard St., Summit Hill, was sentenced by Judge Joseph J. Matika to serve one to two years in a state correctional institution followed by two years of state probation. The one year is the high-end of the standard range of state sentencing guidelines. He also must register as a sexual offender for 15 years under the provisions of Megan's Law.Klingaman previously pleaded to two counts of corruption of a minor - the first count a felony three and the second a misdemeanor one. Klingaman originally had 226 counts related to the sexual assault of a young girl, filed against him. He is still facing 58 other counts filed by Lehighton police.A pretrial conference concerning those charges is scheduled for 9 a.m. Sept. 2 at the courthouse in Jim Thorpe.Defense attorney Gregory Lee Mousseau, of the public defender's office, told Matika his client realizes the seriousness of the charges and the consequences of his action. He said that when released from prison, Klingaman will live in the Parryville area.Klingaman told the court, "I'm very sorry for what I've done. I understand the seriousness of what I done."He said he realizes the emotional damage he did to the victim."What I did to her was extremely wrong," he told the court, adding, "I should have known better."The victim read a statement to the court stating she still has a hard time handling what happened to her."I trusted you and you took advantage of me."Noting she still is receiving counseling, she added, "I know I will get through it."Assistant District Attorney Joseph D. Perilli, who prosecuted the case, said, "The betrayal here is great."Matika said he was not going to sentence Klingaman to a county prison term, noting, "You got a huge break in the plea agreement."Matika added, "You violated this child. It's obvious she is permanently scarred. It will be a scar that will always be there."Summit Hill Chief of Police Joseph J. Fittos and Lehighton Detective Scott T. Preboznyak filed the charges.Charges in Summit Hill included 40 counts of statutory sexual assault with the person being under age 16, 40 counts of involuntary deviate sexual intercourse of an individual less than 16 years old, 40 counts of aggravated sexual assault of an individual under age 16, two counts of corruption of minors, 40 counts of indecent assault with a minor and four counts of terroristic threats.The Lehighton charges are 12 counts of indecent assault of a person less than 16 years of age, 12 counts of corruption of a minor, 12 counts of aggravated indecent assault, 11 counts of involuntary deviate sexual intercourse of an individual under age 16 and 11 counts of statutory sexual assault of an individual.The charges stem from incidents that occurred between Sept. 1, 2014, and Dec. 3, 2015.Police said that on at least two occasions, in September and October 2015, Klingaman had the teen smoke methamphetamine and then commit sexual acts. Mousseau told Matika at the plea hearing that the drug smoked was marijuana.Fittos said he received the report of the offenses on Jan. 28, 2015, and then interviewed the victim. He wrote in the affidavit that the girl told him that Klingaman had sexual relations with her on a daily basis."He told her at least four times that if she told anyone, he would kill her and then himself," Fittos wrote in the affidavit. "The defendant and the youth would also smoke marijuana, which the defendant gave the money to the youth to purchase the drug."He was also charged with four counts of terroristic threats, which were included in the 168 total filed by Fittos.Matika also ordered Klingaman to obtain a drug and alcohol evaluation, supply a DNA sample, submit to a sexual offender's evaluation, have no contact with the victim, no contact with children other than his own, and pay court costs of about $1,000.Klingaman, who has been in jail since his arrest unable to post bail, was given credit for 197 days spent in prison on the charges.
