A Carbon County woman was sentenced to 11 more days in prison than the mandatory minimum term on a driving under the influence charge on Monday in the county court. She was one of nine defendants who previously pleaded guilty to drunken driving charges.

Third offenseKelsey Dee Berkes, 22, of Lehighton was sentenced to serve 21 days to one day less 24 months in prison by President Judge Roger N. Nanovic II. She was arrested on Nov. 7, 2015, along Route 209 in Franklin Township by state police at Lehighton. A test showed 0.15 BAC.Nanovic noted that the conviction was her third for DUI in a six-month span.He told Berkes, "Why shouldn't I give you more time?"Berkes told Nanovic she has since entered an outpatient counseling program and attends Alcoholics Anonymous meetings weekly.In addition to the jail term, Nanovic ordered her to pay a fine of $1,500, license suspended for one year, zero tolerance for drug and alcohol use and continue her counseling and attending AA meetings.She will serve the prison term on consecutive weekends beginning Aug. 25 at 6 p.m. on Thursdays through Sundays.Two DUIsThree defendants were sentenced after pleading previously to two counts of DUI.Jeffrey Hosier, 28, of Lehighton, was sentenced to serve 72 hours to six months in jail on each count with the terms running concurrent to each other and concurrent with another sentence he is serving.Hosier was arrested on the first DUI on March 6, 2015, along Bridge Street in Weissport by state police at Lehighton. A test showed the presence of a controlled substance. The second DUI occurred on May 5, 2015, in the parking lot of the Rite Aid Pharmacy in Palmerton. State police at Lehighton observed a vehicle being driven erratically and made a traffic stop. A test revealed the presence of a controlled substance.Nanovic also ordered that Hosier can only be released on parole to a long-term inpatient rehabilitation program. Hosier previously entered the Salvation Army inpatient program but left after five weeks.Additionally, Hosier must pay fines totaling $2,000, his license was suspended for two years and he must get a mental health evaluation.Philip Myers, 44, of Andreas, was arrested on June 3 and again on June 24, both by Mahoning Township police.On the first count Nanovic placed him on probation for six months and imposed a fine of $300. On the second count he was sentenced to serve five days to six months, a fine of $750, one-year license suspension and zero tolerance for alcohol use.He will begin the jail term at 6 p.m. Aug. 19 and serve it on consecutive weekends with two days the first two weekends and a day on the third.Gregory Cadugan Jr.,45, of Jim Thorpe, was arrested on Sept. 1, 2014, along Route 209 in Lehighton by state police at Lehighton with the second arrest occurring on May 4, 2015, along Route 248 at Bowmanstown, also by state police at Lehighton. In both incidents a test revealed the presence of a controlled substance.He was sentenced to serve 72 hours to six months on the first count and 90 days to five years on the second, with the terms running concurrently. He was given credit for five months spent in the Salvation Army inpatient program and paroled.He was ordered to pay total fines of $3,000, and his license was suspended for two and a half years.Other DUIsJohn Michael Snyder, 43, of Lehighton, was arrested on July 4, 2015, along Fairyland Road in Franklin Township by state police at Lehighton. A test showed 0.26 BAC. He also pleaded to driving under suspension-DUI related.It is Snyder's sixth overall conviction for DUI, Nanovic noted.He was sentenced to serve six to 12 months in prison on the DUI charge and 90 days on the suspension count with the terms running concurrently. He must also pay fines totaling $2,500 and license suspended for a year on the DUI count and another year added for the suspension charge.He began the jail term immediately and was granted work release privileges.Andrew Peter Depalma, 54, of Lehighton, was arrested on July 2, 2015, along Route 248 at Bowmanstown by state police at Lehighton. A test showed the presence of a controlled substance.Nanovic sentenced him to serve 30 days in jail followed by 59 months in the county's Intermediate Punishment Program with the first two months on electronic monitoring. He was fined $1,500, his license suspended for 18 months and he must get a mental health evaluation.He was given credit for 24 days spent in an inpatient rehab program. He will begin serving the six days left on his prison term on Aug. 15 at 5 p.m.Patrick Joseph Janecki, 24, of Albrightsville, was arrested on Sept. 13, 2015, along Meckesville Road in Penn Forest Township by state police at Fern Ridge. A test showed 0.10 BAC.He was sentenced to serve five days to six months in jail, a fine of $750 and one-year license suspension.He will begin the jail term at 7 p.m. Aug. 19 and serve it on consecutive weekends of two, two and one days.Mark Steven Holland, 50, of Jim Thorpe, was arrested on Aug. 15, 2015, along Lafayette Avenue by Palmerton police. A test revealed a 0.17 BAC.He was placed on probation for six months and ordered to pay a fine of $300.Matthew Charles Althouse, 20, of Bowmanstown, was arrested on Dec. 6, 2015, along Mauch Chunk Road in Palmerton by state police at Lehighton. A test showed the presence of a controlled substance.Nanovic sentenced him to serve 72 hours to six months in jail, a fine of $1,000 and a one-year license suspension. On a charge of possession of drug paraphernalia he was placed on probation for a year, concurrent with the DUI charge.He began the jail term immediately.Each defendant must also pay court costs of about $1,000, pay a $50 per month supervision fee while on probation or parole and follow all recommendations of their drug and alcohol evaluation.
