East Penn: clean up debris Troxell has 24 hours to clean up or face contempt charges

Clair Troxell, the owner of the Troxell Trucking Company on East Lizard Creek Road, has been put on notice by the East Penn Supervisors that he has 24 hours to get his debris behind the court-ordered fence or face a contempt of court charge.

During the meeting Tuesday, the Troxell property once again appeared on the agenda in regard to a U-Haul trailer, busted engine and several bags of visible garbage outside the fence."I was there at 2 p.m., and he still had stuff in the front of the fence," said Carl Faust, the township's zoning officer and building code official."There's an old engine, also a U-Haul trailer. I said that'll have to go and Troxell said it had been there for 20 years and is used as storage," Faust said.According to the court order issued by Carbon County Judge Joseph Matika, everything on the property must be behind the screening fence.Troxell was at the meeting and told the board, "Everything has been moved.""Two service trucks were moved, the barriers are moved. The U-Haul is still there, but that's up to the board if it's not in compliance. The motor was abandoned by a previous tenant," he told the board."We have a court order and a $600,000 fine, when do we go in for contempt of court," said board Chairman William Schwab."It's been 12 years. Enough is enough already," he said."I thought I was in compliance," said Troxell."Since there is confusion, you have 24 hours to get it moved. Carl will be out to check. If that can't be complied with, we will continue with our action. It needs to be all cleaned up," said Vice Chairman Richard DeLuca.A motion was passed by the board to give Troxell one last chance to clean up before authorizing township solicitor Jenny Y.C. Cheng to pursue contempt charges.
