Carbon County court - DUI

Two defendants who previously pleaded guilty to driving under the influence were sentenced on Monday afternoon in Carbon County court.

Judge Steven R. Serfass imposed sentences on the following:Harold W. McFarland III, 30, of Sugarloaf, was sentenced to serve 90 days to five years in jail, a fine of $1,500, one-year license suspension and render 100 hours of community service.He was arrested May 22, 2015, along Bridge Street in Lehighton by state police at Lehighton. A test revealed the presence of a controlled substance.He claimed he spent 31 days in an inpatient rehabilitation program but could not produce any proof. Serfass gave him until noon Friday to provide the proof, and if he does he will get 31 days credit toward his prison term.He will begin the prison term at 5 p.m. May 27 and serve it on consecutive, two-day weekends.Ronald David Getter Jr., 22, of Walnutport, was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension and render 25 hours of community service.He was arrested on Nov. 6, 2015, by Mahoning Township police after his vehicle struck a parked car along North First Street (Route 209). At the scene police seized marijuana, a digital scale, grinder, baggies and more than $400 in cash. He pleaded to possession of drug paraphernalia for the items found. A test revealed the presence of a controlled substance.On the possession count he was fined $300 and costs.He will begin the jail term on June 3 at 2 p.m.Both defendants must also pay court costs of about $1,000 and a $50 per month supervision fee.Bail revokedJasmine Lynne Conner, 34, of Lehighton, was scheduled to be sentenced on a DUI charge but instead had her bail revoked and placed in the county prison.At the guilty plea hearing Serfass told Conner she had to get a drug and alcohol evaluation and a comprehensive evaluation before her sentencing date. She appeared Monday without either being done and claimed she attempted to arrange for the testing but did not receive return calls from the drug and alcohol office. She then said she spoke to someone in that office Monday morning who told her she could get the two evaluations done in one day and gave a name of the person she talked with.A member of the adult probation office checked with the drug and alcohol office and the three employees who would handle such calls said none of them had spoken to Conner on Monday.Serfass then revoked her $5,000 unsecured bail and reset it at $2,500 percentage meaning she needed to come up with $250. She did not have it and was remanded to the county prison. Serfass also ruled that if she comes up with the $250 bail she can't be released from the prison until she has the two evaluations completed at the jail.
