Fraud alleged

Sargent Enterprises Inc., of 732 Center St., Jim Thorpe, has filed a civil complaint against Al Sebia, individually, and also doing business as America Coast to Coast Business Solutions, LLC, with an address at 105-107 Carbon St., Weatherly.In the suit the plaintiff alleges unjust enrichment, breach of contract and fraud against the defendants.The suit states on or about March 19, 2012, the parties entered into a written contract for professional employer administration services whereby America Coast to Coast was to provide services by and through Sebia to the plaintiff.The suit further states the defendants were to provide and pay the costs of all necessary workers' compensation insurance for all work site employees for injuries sustained during the course and scope of employment as required by state law. The defendants were also to "invoice plaintiff for an amount equal to the wages, FICA, federal and state unemployment taxes, workers' compensation insurance premium accured, etc."Among the allegations in the action is that the defendant invoiced the plaintiff for workers' compensation insurance but failed to make payment upon the workers' compensation insurance or payroll taxes; failed to pay the third quarter payroll taxes; fourth quarter also not paid; plaintiff notified a workers' compensation claim was made but plaintiff discovered that the workers' compensation insurance was likewise not paid. These issues were discovered in or around December 2014.Because of these issues the plaintiff was forced to hire counsel to represent it for the workers claim, had to pay the third and fourth quarters of 2014 unemployment payroll tax returns which the plaintiff had already paid the defendant.The plaintiff has made numerous requests of the defendant to reimburse them for the monies extended but nothing has been paid by defendants, the suit alleges.Sought are damages in the amount of $36,998.37 together with interest and costs.Suit over workKurtis Keinert, 180 Little Gap Road, Palmerton, filed a civil complaint against James and Kimberly Jacobs, dba Jacobs Ladder Roofing Inc., all of 327 Oxford Place, Macungie.The suit states in August 2013 the plaintiff inherited the estate at 180 Little Gap Road. In October 2013, the defendants offered to renovate the house for the plaintiff for $35,000 with the details of the work outlined in the suit. The suit alleges payments were made by the plaintiff to the defendants for the work which was to be done by Thanksgiving 2013. The work was not done by that time and the defendants said it would be continued in January 2014 due to weather. Subsequent to that, sometime in December 2013 numerous pipes burst in the house due to lack of heat, insulation, etc.The suit alleges the work was not finished as promised, money was paid and the defendants have refused to continue the work unless they receive more money from the plaintiff, which the suit said has already made payments. The suit further alleges the work was not done, and other damages, etc., detailed in the suit.Sought are damages for unworkmanlike performance and failure to complete the work.
