Carbon County court - DUI

Five defendants who previously pleaded guilty to driving under the influence charges were sentenced Monday in Carbon County court.

Judge Steven R. Serfass imposed sentences on the following:Nicholas J. Cantelmi, 26, of Jim Thorpe, also pleaded to a theft charge in an unrelated case.He was arrested on the DUI charge on June 21, 2015, along Berwick Street by Beaver Meadows police. A test revealed the presence of a controlled substance. He was arrested on the theft count on Dec. 5, 2014, by state police at Lehighton for an incident along Wild Creek Road in Penn Forest Township.On the DUI charge he was sentenced to serve 90 days to 60 months in prison, a fine of $1,500, license suspended for 18 months and when released render 100 hours of community service. On the theft charge he was placed on probation for a year, concurrent with the DUI count, and render another 50 hours of community service. He was given credit for 28 days spent in jail to date on the DUI count.Jordan Grammes,21, of Albrightsville, was arrested on Aug. 19, 2015, by Mahoning Township police along Route 209 at a DUI checkpoint. At the time of the stop Grammes had two children in her back seat, ages 2 and 5. A blood test showed the presence of controlled substances.She was sentenced to serve 37 days to 60 months in prison, pay a fine of $1,500, license suspended for 18 months and zero tolerance for drug and alcohol use. She was given credit for 14 days spent in an inpatient rehab program. She must report to the county prison at 9 a.m. April 18 to finish her sentence. However, if can produce proof of 23 days spent in another rehab inpatient program she will be paroled without serving any more time.Robert Francis Dreste III, 26, of Palmerton, was arrested on Aug. 8, 2015, along Delaware Avenue in Palmerton by state police at Lehighton. A test showed the presence of a controlled substance.He was placed in the state's Intermediate Punishment program for two years which runs concurrent to the same sentence imposed in Monroe County. The state IP program has a defendant serve seven months in jail, then an extended period in an inpatient drug and alcohol program followed by time in a halfway house. When released on parole he must render 100 hours of community service.Scott Edward Hoats,47, of Lehighton, was arrested on Sept. 29, 2014, along Mauch Chunk Street by Mahoning Township police. A test showed 0.18 BAC.Serfass sentenced him to serve five days to six months in jail, a fine of $500, one-year license suspension and render 25 hours of community service.He will begin the jail term at 5 p.m. April 22 and serve two days; April 29, two days; and May 7 one day.Chad Michael Derr,37, of Slatington, was arrested on Aug. 30, 2014, along Mauch Chunk Street by Mahoning Township police. A test showed 0.10 BAC.He was sentenced to serve 10 days to 24 months in jail, a fine of $500, one-year license suspension and render 100 hours of community service. He was given credit for 13 days spent in jail on the charge and paroled.Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole or probation.
