Man gets probation in drug delivery charge

A Jim Thorpe man was placed on probation Monday on a drug delivery charge.

Eric Michael Safianow, 21, was sentenced by Judge Joseph J. Matika on a charge of possession with intent to deliver a controlled substance and also on a charge of possession of drug paraphernalia. His total sentence is 30 months probation. He previously pleaded to the charges.Safianow was arrested on the delivery charge on Aug. 17, 2014, in the area of 101 E. 10 St., Jim Thorpe. He was charged after he sold cocaine to a confidential informant working for borough police. The paraphernalia charge stems from a vehicle stop that occurred on June 20, 2014, by state police at Lehighton along Route 209 in Jim Thorpe. Police found cocaine in the vehicle.Matika said he would give Safianow a probation sentence because he felt the case was one of drug addiction, not selling. He said Safianow was involved in the sale so he could get money to support his habit.Defense attorney Matthew J. Rapa said his client also suffers from mental health issues. He said his client, when on his medication, is coherent and is not a risk to commit crime. However, he said when he is off his medications he is a hard person to deal with.Matika also noted that Safianow has gone through several inpatient rehab programs and then relapsed, which concerns the court. He said his sentence will include Safianow getting a drug and alcohol evaluation and following any recommendations for treatment.Matika said Safianow's failure to follow through with the recommendations would be a violation of his probation and would probably mean jail time.Safianow was also ordered to get a mental health evaluation, zero tolerance for drug and alcohol use, render a total of 125 hours of community service, supply an DNA sample, pay court costs of about $1,000 and pay a $50 per month supervision fee while on probation.
