Carbon County court - DUI

A Palmerton man was sentenced to a county prison term Tuesday in Carbon County court after previously pleading guilty to two counts each of driving under the influence and driving while under suspension-DUI related.

He was one of five defendants to be sentenced on drunken driving charges they previously pleaded guilty too by Judge Steven R. Serfass.Palmerton incidentsCarl Lloyd Miller, 61, was sentenced to a total of 12 to 60 months in prison on the charges. He was arrested along Third Street in Palmerton by state police at Lehighton. A test revealed a 0.24 BAC. The second arrest occurred along Delaware Avenue in Palmerton by state police. A test revealed a 0.08 BAC.In addition to the prison term, Miller must pay total fines of $5,000, and license suspensions totaling 54 months. He must also render 100 hours of community service when released on parole. He will begin the jail term at 9 a.m. March 10. He was given credit for five days spent in jail on the charges.Other casesOther defendants sentenced on DUI counts included:Keith Kocher, 27, of Sugar Notch, Luzerne County, was sentenced to serve 30 days in jail followed by 59 months in the county's Intermediate Punishment Program - house arrest - with the first 60 days on electronic monitoring. He must also pay a fine of $1,500, license suspended for 18 months and render 100 hours of community service when released on parole. He will begin the jail term on March 11 at 9:30 p.m. and serve it on consecutive three-day weekends.Kocher was arrested on July 24, 2015, at a checkpoint operation along Maury Road in Penn Forest Township. A test revealed he was under the influence of a controlled substance.Robert John Barthol, 46, of Weissport, was sentenced to DUI and driving under suspension-DUI related charges.On the DUI count he was sentenced to serve 72 hours to six months in jail, a fine of $1,000, license suspended for a year and render 25 hours of community service. On the suspension count he was sentenced to serve 45 to 90 days in jail, but must serve the full 90 days, pay a fine of $1,000, and his license will be suspended for another year.He will begin the jail term on March 4 at 7 p.m. and serve it on consecutive two-day weekends.He was arrested on Oct. 9, 2014, by state police at Lehighton along Iron Street in Lehighton.Brandon Jonathan Fuller, 21, of Mechanicsville, Virginia, was sentenced to serve five days to six months in jail. He was arrested on July 5, 2015, in the area of 688 Behrens Road in Penn Forest Township after being involved in a crash. A test showed 0.13 BAC.He was also fined $300, license suspended for one year and ordered to render 25 hours of community service. He began the jail term immediately.Michael Anthony Damico, 49, of Whitehall, was sentenced to serve 10 days to 24 months in prison. He was also fined $500, license suspended for a year and ordered to render 100 hours of community service. He was arrested on Aug. 8, 2015, along Delaware Avenue in Palmerton by state police at Lehighton. A test showed 0.11 BAC.Damico is currently serving a term for DUI in Lehigh County in the IPP program, which runs until April 30. Serfass ruled his sentence run concurrent with Lehigh.Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole.
