Evans, 26, was charged by Nesquehoning police for an incident on Dec. 15, 2012, at a residence along West Catawissa Street.Police were dispatched to the residence for a report of suspected child abuse. On scene officers were told the mother of a young girl and boy left them with Evans while she left the residence. While she was gone Evans admitted inappropriately touching the girl, who was 10 at the time. He pleaded to indecent assault, as a misdemeanor 2.Defense attorney Paul J. Levy told the court that his client has a history of mental health issues which began two years before the incident. He also said because of those issues and with the agreement of the victim's family, the commonwealth dropped another count of indecent assault, rated a misdemeanor 1, along with a count of corruption of a minor, a felony 3. The agreement calls for a probation sentence.Matika deferred sentencing because the charge falls under the provisions of Megan's Law. Evans will have to undergo an evaluation by the state sexual assessment board to determine if he is a sexually violent predator. If it is determined he is a sexually violent predator, he will have to register as a sexual offender for the rest of his life. If not, then the registration period is 15 years. Matika also ordered a presentence investigation report be prepared by the adult probation office.
