Carbon County court - Theft cases

Eight defendants entered guilty pleas in Carbon County court on Tuesday to theft and related charges.

Judge Joseph J. Matika accepted the pleas from the following:Walmart theftsStanley Wayne Carter, 27, of Drums, Luzerne County, pleaded guilty to two retail theft charges for two incidents at the Walmart store in Mahoning Township.He admitted taking a computer and camera on April 24 and then a television on April 25.Carter told Matika has an addiction problem and spent 20 days in an inpatient rehabilitation program.Matika placed him on probation for a year on each count, running consecutively, and ordered he make restitution of $498, a half-share as there is a co-defendant in one of the cases; render a total of 100 hours of community service, get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance imposed on D&A use, and not go into the store during the probation period.Other pleasOther defendants pleading included:Danielle Louise Jaso, 31, of Lansford, pleaded to two counts of retail theft in two incidents at the Turkey Hill store along West Patterson Street in Lansford. She stole energy drinks valued at $1.99 each on May 11 and 21. She is currently in the Monroe County prison on a parole violation, serving a term which runs out of Nov. 27.Matika placed her on probation for a year on each count concurrent with each other but consecutive to Monroe County. She was also ordered to render 50 hours of community service, supply a DNA sample, get a D&A evaluation and stay out of Turkey Hill in Lansford.David Edwin Alberswerth, 51, of Weatherly, pleaded to one count of theft. He admitted taking various power tools from Michael Sanfilippo, at 600 E. Second St., Weatherly, on Jan. 4.Alberswerth said he had a drug addiction problem with heroin which began after he lost his son to a drug addiction problem. He spent 28 days in a rehab facility.Matika placed him on probation for a year and ordered he get a D&A evaluation, zero tolerance for D&A use, render 50 hours of community service, make restitution of $1,434 to the victim and have no contact with Sanfilippo.Robert Joseph Oswald, 50, of Slatington, pleaded to one count of criminal conspiracy-theft, a felony 3. He was charged by East Penn Township police with taking various items, including radiators for vehicles from Troxell Trucking Company, located along East Lizard Creek Road, on or about Dec. 14, 2014. All the items were recovered.Matika placed him on probation for a year and ordered he render 50 hours of community service, supply a DNA sample and have no contact with the victim.Tina Ann Phillips, 37, of Lansford, pleaded to one count of theft. She was charged with taking jogging pants from a residence in Lansford on March 11.Matika placed her on probation for six months and ordered her to render 25 hours of community service.David Scott Stewart, 31, of Jim Thorpe, pleaded to one count of retail theft (as a summary offense) and also possession of drug paraphernalia. He was arrested on July 6 by Nesquehoning police for an incident at Redners Warehouse Market. He took items, including baby food, with a total value of $9.58. While taking him into custody drug paraphernalia was found on him.On the possession count he was placed on probation for a year and ordered to get a D&A evaluation and render 50 hours of community service. On the theft charge he was fined $100.Kevin Alan Dunn, 25, of Lansford, pleaded to one count each of theft of services, criminal trespass and criminal mischief. He was arrested by Lansford police for an incident on Sept. 14 where he entered a garage along East Ridge Street without permission and stayed there, police said.Dunn is currently in the county prison and is facing a probation violation proceeding in Northampton County.On the trespass charge Matika sentenced him to time served (57 days) to one year in jail, render 50 hours of community service, supply a DNA sample, make restitution of $1,107.50 to the victim, and have no contact with the victim.On the other two counts, both summaries, he was fined a total of $200. He will not be released from custody as he faces legal action in Northampton County.Paul D. Weirich, 28, of Coaldale, formerly of Lansford, pleaded to one count of retail theft. He was arrested on May 8 by Lansford police for a theft at the Family Dollar Store along East Patterson Street. He took an item valued at $5.30.Matika sentenced him to serve 30 days to one year in jail, render 50 hours of community service when released, and not enter the store in Lansford. He is currently in the Lehigh County prison on a parole violation.Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
