Appeal in 1990 arson death case denied for fifth time

A Mahanoy City man who set a fire that killed a man in 1990 has had his appeal of a life sentence denied for a fifth time.

A panel of Superior Court judges on July 14 denied the Post Conviction Relief Act appeal filed by Elwood P. Hopkins, 62, who is in Graterford state prison, Montgomery County.A Schuylkill County jury on Nov. 14, 1990 found Hopkins guilty of setting the fire at 17-23 W. Chester St. on Jan. 19, 1990.The blaze damaged an apartment building and the adjacent Valley Personal Care Home.A resident of the home, Harry Kraut, died as a result of injuries caused by the fire.Hopkins was arrested and charged with several crimes.The jury acquitted him of both second and third degree murder, but convicted him of involuntary manslaughter, arson, endangering persons, arson endangering property and reckless burning or exploding, for which he was sentenced to life imprisonment without parole.The ruling, filed with Schuylkill County on Aug. 24, states that Hopkins has "filed numerous appeals from the denial of relief by the PCRA courts, raising an assortment of claims."Hopkins filed his fifth appeal on Sept. 9, 2014. The court dismissed his claim due to a "lack of jurisdiction, based ion untimeliness."
