Defendants plead guilty in drug cases

A total of seven defendants charged with drug-related counts entered guilty pleas in Carbon County court on Tuesday.

Judge Joseph J. Matika accepted the pleas from the following:Steven Richard Swartz, 26, of Palmerton, pleaded to one count of possession with intent to deliver a controlled substance.He was arrested on Feb. 6, 2014, by the narcotics unit of the state police at Hazleton. Police arranged a controlled buy using a confidential informant.Swartz sold Percocet to the CI. After the sale, troopers obtained a search warrant for Swartz's residence at 289 Harvard Ave. and found methamphetamine in the home. The plea was to the meth possession.Matika deferred sentencing and ordered the adult probation office to prepare a presentence investigation report.Eric Michael Safianow, 20, of Jim Thorpe, entered pleas in two pending cases to one count each of possession with intent to deliver a controlled substance and possession of drug paraphernalia.The first count stems from an incident on Aug. 17, 2014, at 101 E. 10 St. in Jim Thorpe. He was charged after he sold cocaine to a CI working for borough police. The second charge stems from a vehicle stop that occurred on June 20, 2014, by state police at Lehighton along Route 209 in Jim Thorpe. Police found cocaine in the vehicle.Matika deferred sentencing and ordered a PSI.Joseph Donald Franklin, 32, of Brookhaven, Delaware County, and formerly of Lehighton, pleaded to one count of criminal use of a communication device.He was arrested on Oct. 15, 2014, along Second Street by Mahoning Township police as part of a drug investigation.Franklin delivered heroin to a CI with the buy set up via a phone call made by the CI to a co-defendant in the case.Franklin is currently an inmate in the Delaware County prison serving a parole violation sentence.Matika sentenced him to serve three to one day less 18 months in the county prison with credit for 106 days already served.He was also ordered to render 50 hours of community service, get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance imposed for D&A use, pay court costs of about $1,000, pay a $50 per month supervision fee, and supply a DNA sample.Barry Alfred Tindula, 33, of Palmerton, pleaded to one count of criminal use of a communication device.He was arrested by agents of the state Attorney General's office after he sold methamphetamine to a CI which was set up by a phone call.Tindula is currently an inmate in the county prison on the charges.Matika deferred sentencing ordering a PSI.Raymond Larue Sitler, 24, of Lehighton, pleaded to one count of possession with intent to deliver a controlled substance.He was arrested on March 18 by Mahoning Township police for an incident in the area of 140 N. Fourth St. The county drug task force arranged a buy from Sitler of heroin to a CI.Matika deferred sentencing and ordered a PSI.Cheyenne Corrynne Miller, 22, of Allentown, and formerly of Lansford, entered pleas in two pending cases to one count each of possession of marijuana and possession of drug paraphernalia.She was arrested on the marijuana count on March 20, 2012, by Mahoning Township police following a vehicle stop. She was a passenger in the vehicle.The second arrest occurred on Jan. 10 by state police at Lehighton following another traffic stop in which she was a passenger in the vehicle.She is currently an inmate in the Lehigh County prison serving a sentence for a probation violation.On the paraphernalia charge Matika placed her on probation for a year and ordered her to get a D&A evaluation, zero tolerance for D&A use, pay court costs of about $1,000, pay a $50 per month supervision fee while on probation, and render 50 hours of community service. On the marijuana count she was fined $100 and costs.The sentence runs consecutive to her Lehigh County term.Kristin Nina Hickey, 49, of Jim Thorpe, pleaded to one count of possession of a controlled substance-suboxone.She was arrested on May 4, 2014, by Jim Thorpe police in the area of 25 E. Third St., after police received a report that she had an illegal substance in her possession from a family member.She is currently in a methadone program for a drug problem.Matika placed her on probation for a year and ordered her to get a D&A evaluation, zero tolerance for D&A use, pay court costs of about $1,000, pay a $50 per month supervision fee while on probation, and render community service.
