Walnutport man gets long state prison term for assault

A Walnutport man was sentenced to a long state prison term on Monday on aggravated assault by vehicle while driving under the influence and other counts.

Mark C. Binder, 27, , formerly listed a Jim Thorpe address, was sentenced by Judge Steven R. Serfass to serve a total of 21 to 48 months in a state correctional institution on two counts of DUI, the assault charge, and receiving stolen property. He previously pleaded guilty to the charges, which stemmed from three pending cases.Binder was charged with the aggravated assault count for an incident on Dec. 13, 2013, along South Third Street in Lehighton. He was driving by a crash scene and failed to stop when directed by officer Matthew Binder, of the Lehighton police. He struck Binder with his vehicle. He submitted to a blood test, which resulted in a 0.25BAC.The other DUI charge was the result of a incident along Pohopoco Drive, in Towamensing Township, filed by state police at Lehighton. A test showed 0.18BAC.The receiving charge involved an incident in Lehighton.Binder told Serfass, "I'm prepared to go up state. It was a stupid thing I did."Defense Attorney Paul Levy asked Serfass to impose a county jail term because of the amount of time Binder has already spent in jail on the charges, but the request was rejected.Serfass imposed 15 to 36 months on the assault count and 30 days to six months on the DUI charge, with the terms running concurrently.On the second DUI a jail term of 90 days to 60 months was imposed, also concurrent.On the receiving charge Serfass imposed a six to 12 month state term, consecutive to the other counts.Binder was also ordered to pay total fines of $3,250 on the DUI charges and total license suspensions of two and a half years, get a drug and alcohol evaluation, and supply a DNA sample.He was given credit for 457 days already spent in prison on the charges.
