Hearings waived in cellphone robbery Charges sent to court for three of the defendants; hearing is continued for juvenile

Three hearings were waived and one was continued Friday in the armed robbery of two girls, ages 12 and 13, in Nesquehoning.

The hearings were scheduled before District Judge Casimir Kosciolek in Lansford.Defendants in criminal cases can choose to have a preliminary hearing before a district judge or forgo the hearing and have the charges sent to trial in county court.The charges stem from an incident at 7:45 p.m. Jan. 17 in the 300 block of East Center Street in Nesquehoning. The two young girls said they were approached by six individuals, three of them carrying handguns, who took a cellphone from one of thegirls.Waiving their hearings were:• Elijah Michael Frey, 18, of Nesquehoning, who not only faces charges in regards to the armed robbery, but was arraigned on separate charges regarding resisting arrest in Nesquehoning. Kosciolek retained Frey's bail at $150,000 cash for the robbery charges and $5,000 cash for the resisting arrest charges.• Izael Flores, 18, of Nesquehoning, who is in the Carbon prison in lieu of $100,000 cash bail.• Tyquan Shakeem Owens, 18, of Lansford, who is free on $100,000 unsecured bail with a school stipulation.The hearing for Talon Wesley Lewis, 17, of Summit Hill, a juvenile being charged as an adult, was continued pending a juvenile petition action, said District Attorney Jean Engler.Another juvenile has been charged, but his name was not released because he is being charged as a juvenile, not as an adult.The sixth person was never identified.All the defendants are facing multiple charges, including conspiracy and robbery. Frey also faces charges of resisting arrest and three counts of simple assault. These charges stem from Jan. 20, when police were trying to place Frey under arrest. The affidavit says that Frey struggled with officers who attempted to place him into custody until Chief of Police Sean Smith used a stun gun on him.Regarding the alleged robbery of the phone from the girls, the affidavit says the armed individuals "physically pushed their handguns into the victims' ribs and arms."The victims, the affidavit says, begged to have the phone returned, but the individuals refused and began walking away.The affidavit says Frey is known as "Big E" and is known to police because of his large physical size.
