A Carbon County man and woman who led various police from the county and state police personnel on a search will have their case heard in Carbon County Court.
Michelle Kobal, 45, of Lehighton and James Smiley, 43, of Palmerton were scheduled to have preliminary hearings Wednesday before District Judge William Kissner of Palmerton. But, instead, both Kobal and Smiley waived their right to a hearing and are scheduled to appear for a pretrial status conference at 1:15 p.m. Feb. 12 in the district attorney's office at the courthouse in Jim Thorpe. Both Kobal and Smiley face charges of flight to avoid apprehension and resisting arrest. Bail was set at $5,000 unsecured for both. Both Kobal and Smiley have been returned to Carbon County Correctional Facility for previous probation violations.According to an affidavit of probable cause filed by Palmerton Borough patrolman Shawn Leadbetter:At 9:59 a.m. Oct. 23, Leadbetter was dispatched by the Carbon County Communication Center to 769 West Edgemont Ave. for an assault involving Smiley and Kobal, who both had active warrants.Upon arrival at 10 a.m. Leadbetter walked to the rear of the residence where he observed from a distance Smiley and Kobal running into the wooded area, ignoring his commands.Leadbetter then began a foot pursuit into the wooded area toward both suspects. He notified the Communications Center that he was in foot pursuit and requested backup.Leadbetter was able to apprehend Smiley, who was taken down at the point of a stun gun and handcuffed.Smiley said he stopped running so Kobal could get away. While taking Smiley into custody, Kobal, who had an aggressive pit bull with her, continued running deeper into the wooded area. The Carbon County Sheriffs Department confirmed both arrest warrants for Smiley and Kobal.Kobal was on probation for being charged with driving under the influence and fleeing or attempting to elude police for her involvement in a 12-mile high-speed chase in May, while Smiley was on probation for recklessly endangering another person and criminal mischief. At that time, Leadbetter requested units to respond to the Village at Palmerton and check the wooded area from that point, and head west while Leadbetter continued checking the area up to Alliance Sand Corporation property, and east behind the water tanks and continued working his way east in an attempt to apprehend Kobal. While searching, Leadbetter attempted to get the K-9 unit to respond, but the Palmerton Township Police Department and Emmaus Police Department K-9 units were unavailable.Leadbetter, as well as officers from the Lehighton Police Department, Franklin Township Police Department, East Penn Township Police Department, and state police at Lehighton continued to search for Kobal but were unsuccessful. While Smiley was in custody, he said another woman came home earlier to find Smiley and Kobal having sex.He said that started a verbal argument with all three parties, at which time the other woman dialed 911, leading to authorities being called to the home.Smiley was then released into the custody of the Sheriffs Department. On Nov. 4, Kobal was located in Bowmanstown by Palmerton Police and East Penn Township Police.
