Pleas entered in prescription ring

Two defendants who participated in a forged prescription ring entered guilty pleas in Carbon County court Tuesday and face state prison terms.

A third defendant had her plea agreement rejected by the court.Edward Lee Szczesny, 26, of East Stroudsburg, and Lee Erick Daniel, 25, of Daytona, Florida, each pleaded to a total of 28 criminals counts. The two pleaded to 25 counts of acquiring or obtaining a controlled substance by misrepresentation, and one count each of possession of a controlled substance, corrupt organization and criminal conspiracy. The pleas were to all the charges filed against them by the state Attorney General's office, which is prosecuting the case.A third defendant, Angela McClain, 43, formerly of Palmerton and now of Tobyhanna, had her plea agreement rejected by President Judge Roger N. Nanovic II.McClain was to plea to one count of acquiring or obtaining a controlled substance by misrepresentation with the other charges dropped.Nanovic told McClain's defense counsel, Steven Mills, that "there is something fundamentally wrong with this agreement."Nanovic noted that both Daniel and Szczesny pleaded to all the counts filed against them and another defendant in the case, Charles F. Daniel, 27, of Effort, pleaded in August to all counts filed against him and was sentenced to a state prison term.Nanovic said the affidavit of probable cause indicates that McClain was the main person in the ring. She was a nurse for Dr. Edward Manzella of Palmerton, and provided the others with forged prescriptions of the drug oxycodone, which were then taken to area pharmacies where they were filled. A total of 5,640 tablets of oxycodone were obtained illegally.He said there was something wrong with the plea agreement in which the main participant only had to plea to one count while others in the same case had to plea to all counts filed against them. He called it "unfair" and told Mills he was rejecting the agreement.Nanovic also told Mills he had two choices, to return the case to pretrial status or go to trial. Mills asked the case be sent back to pretrial.Also charged in connection with the case was Jessica Campbell, 26, of Matamoras, Pike County. She was scheduled to plea yesterday to all counts charged but her case was continued to February 2015.The AG office charged that McClain gave forged prescriptions to her boyfriend, Szczesny. The prescriptions, in some cases, were made out to Charles Daniel, Lee Daniel and Jessica Campbell. They were paid between $100 and $200 to fill the prescriptions at the various pharmacies in Carbon, Monroe and Northampton counties.Manzella was shown the names of the suspects and said the four were not his patients.Yesterday, Szczesny denied that he and McClain had a relationship.Charles F. Daniel was sentenced in August to serve 24 to 48 months in a state correctional institution.Szczesny and Lee Daniel both face state prison terms. Both said they wanted the chance to apply for the state Intermediate Punishment Program or the state boot camp program before sentencing.Nanovic deferred sentencing for both defendants and ordered the adult probation office to prepare a presentence investigation report. Lee Daniel is free on bail while Szczesny is an inmate in the Monroe County prison on other criminal matters.
