Twelve first-time offenders placed in probation program

Twelve first-time offenders in the criminal justice system were placed in Carbon County's Accelerated Rehabilitation Disposition probation program on Monday by Judge Steven R. Serfass.

If a person successfully completes all conditions of the program, their record is wiped clean. However, if they fail to complete the program, or are revoked from it, then they will face trial on all pending charges. A person does not admit guilt in entering the program.All were placed for a year, unless otherwise noted.David Albert Charbonnier III, 25, of Lehighton, was placed on a driving under the influence charge. He was arrested on May 17 along Mahoning Street, by Lehighton police. Given a test, the result was 0.23 BAC.He was assessed $550 for the cost of the program and ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, have his license suspended for 60 days, and render 50 hours of community service.Matthew Anthony Defrain, 31, of Palmerton, was placed on a DUI charge. He was arrested on May 25 by state police at Lehighton along Bridge Street in Lehighton. Given a test, the result showed the presence of a controlled substance.He was assessed $600 and ordered to get a D&A evaluation, have his license suspended for 60 days, and render 50 hours of community service.Timothy Marvin Frankenfield, 50, of Whitehall, was placed on a DUI charge. He was arrested on May 31 along Mauch Chunk Street by Mahoning Township police. Given a test, the result was 0.08 BAC.He was assessed $450 and ordered to get a D&A evaluation and render 50 hours of community service.Barbara J. Hiler, 38, of Jim Thorpe, was placed for two years on drug-related charges. She was arrested by agents of the state Attorney General's office on Sept. 12, 2013, along South Street in Jim Thorpe. She allegedly sold hydrocodone to a confidential informant.She was assessed $650 and ordered to get a D&A evaluation, zero tolerance for D&A use, and render 100 hours of community service.Sarah Marie Ripper, 26, of Bethlehem, was placed on a DUI charge. She was arrested on May 23 by state police at Lehighton along Forest Inn Road in Lower Towamensing Township. Given a test, the result was 0.20 BAC.She was assessed $550 and ordered to get a D&A evaluation, have her license suspended for 60 days, and render 50 hours of community service.Todd Vitelli, 26, of Willow Grove, Montgomery County, was placed on a DUI charge. He was arrested on March 2 along Penn Forest Trail in Penn Forest Township by state police at Fern Ridge. Given a test, the result was 0.26 BAC.He was assessed $650 and ordered to get a D&A evaluation, have his license suspended for 60 days, and render 50 hours of community service.Jerry Joseph Cook, 48, of Stanley, New Jersey, was placed on a DUI charge. He was arrested on July 31 along Route 248 in Bowmanstown by state police at Lehighton. Given a test, the result was 0.12 BAC.He was assessed $500 and ordered to get a D&A evaluation, have his license suspension for 30 days, and render 50 hours of community service.Edwina Brett Grow, 37, of Palmerton, was placed for two years on a simple assault charge. She was arrested on Aug. 12 by Palmerton police for an incident along Lehigh Avenue.She was assessed $450 and ordered to get a mental health evaluation, and render 100 hours of community service.Jaryd Donald Henne, 26, of West Hazleton, was placed on a DUI charge. He was arrested on May 25 along Route 209 in Jim Thorpe, by state police at Lehighton. Given a test, the result showed the presence of a controlled substance.He was assessed $600 and ordered to get a D&A evaluation, have his license suspended for 60 days, and render 50 hours of community service.Jesse A. Kline, 25, of Macungie, was placed for two years on a simple assault charge. He was arrested on May 10 by Franklin Township police for an incident in the area of 44 E. Third St.He was assessed $450 and ordered to get a D&A evaluation, zero tolerance for D&A use, and render 100 hours of community service.Dylan Joseph Lavecchia, 20, of Lehighton, was placed for two years on a charge of identity theft. He was arrested by Palmerton police on Aug. 12 for taking a woman's credit card and using it.He was assessed $450 and ordered to render 100 hours of community service.Katrina Lee Sanabria, 29, of Lehighton, was placed for 18 months on a defiant trespass charge. She was arrested on May 14 by state police at Lehighton for an incident in the area of 5247 Interchange Road, in Franklin Township.She was assessed $450 and ordered to get a mental health evaluation and render 75 hours of community service.Each defendant must also pay court costs, which average about $1,000, and pay a $50 per month supervision fee while in the program.
