Defendants in DUI cases enter pleas

Six defendants in pending driving under the influence cases entered guilty pleas in Carbon County court on Thursday.

The six appeared before President Judge Roger N. Nanovic II.Tyler Robert Billings, 22, of Palmerton, was arrested on Oct. 26, 2013, along Delaware Avenue in Palmerton by state police at Lehighton. Given a test, the result showed the presence of a controlled substance.He also arrested on Sept. 7, 2013, for accidents involving attended vehicle. He struck a parked vehicle along Harvard Avenue in Palmerton.He also pleaded to a charge of receiving stolen property for an incident on May 29 filed by state police. He was charged with taking electrical wiring from F.J. Lesher General Construction, at 4195 Fireline Road, in Lower Towamensing Township. Lesher is Billings' stepfather, it was noted.Defense Attorney Paul Levy said Billings has been battling drug and alcohol issues and completed a 30-day inpatient program. He was in a halfway house for two weeks after the inpatient program but left early because his girlfriend gave birth to a child and he wanted to be home with her.On the DUI charge he was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension, get a drug and alcohol evaluation and follow any recommendation for treatment, and must submit to the probation office verification of five job applications per week until he gets a full-time position. On the other two counts he was placed on probation for a year, consecutive to the DUI charge.He must also make restitution totaling $4,301 for damages in the crash.He will begin the jail term at 10 a.m. on Oct. 20.Robert Joseph Dorward, 45, of Lehighton, was arrested on Feb. 14 at Beltzville State Park in Towamensing Township by park rangers. Given a test, the result was 0.15 BAC.A first offense, he was placed on probation for six months and ordered to get a D&A evaluation, make restitution of $160.68, and pay a fine of $300. On a summary offense of not wearing a seat belt, he was fined $10.William P. Smith, 54, of Lehighton, was arrested on May 25 along Second Street in Lehighton by state police at Lehighton. Given a test, the result was 0.12 BAC.He was placed on probation for six months and ordered to get a D&A evaluation and pay a fine of $300.Scott Wayne Smith, 48, of New Tripoli, was arrested on Nov. 29, 2013, along Route 248 in Franklin Township by state police at Lehighton. Given a test, the result was 0.19 BAC.He was sentenced to serve five days to six months in jail, pay a fine of $500, one-year license suspension, get a D&A evaluation, and continue his after-care treatment. He was given credit for 28 days spent in an inpatient rehab program and was immediately paroled.Robert J. Schneider, 27, of Palmerton, was arrested on June 9, 2013, along Lehigh Avenue by Palmerton police. A test revealed the presence of a controlled substance.He was sentenced to serve 72 hours to six months in jail, a fine of $500, one-year license suspension, and get a D&A evaluation.Schneider is currently serving a state prison term of 13 months for a parole violation. Nanovic ruled the DUI sentence would run concurrent with his state sentence.Marc E. Stoss, 44, of Weissport, was arrested on Oct. 1, 2013, along Canal Street in Weissport. Given a test, the result was 0.22 BAC.Sentencing was deferred.Each defendant sentenced must pay court costs, which average about $1,000, and pay a $50 per month supervision fee.
