Lehigh man given jail term for DUI, drug possession

A Lehigh County man, who led police on a foot chase through backyards in Jim Thorpe, was sentenced to a county prison term on Friday after pleading guilty to a drug count and drunken driving charges.

David Allen Poniktera Jr., 22, of Fountain Hill, was sentenced by Judge Steven R. Serfass to a total of three months and three days to 18 months in prison followed by 24 months on probation.He pleaded to one count each of driving under the influence, resisting arrest, possession of a controlled substance-heroin, and false identification to law enforcement.He was arrested following an incident on May 11. Borough police observed a vehicle being driven erratically along Sixth Street and attempted a vehicle stop.Poniktera at first refused to stop but then did in the area of Bob's Market at 15 W. Sixth St. He exited the vehicle and ran on foot through various backyards until he was apprehended by police.When caught, he gave police a false name. Police found 30 bags of heroin in the vehicle.He was originally charged with other drug counts and motor vehicle code violations.Most were dropped in a plea bargain.On the drug count Serfass sentenced him to serve three to 12 months in prison, and on the DUI charge, 72 hours to six months, consecutively. He was given credit for three days on the DUI charge and paroled. He was given 15 days credit on the drug count.On the resisting arrest he was placed on probation for 24 months, consecutive to the other terms.He was also ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance for D&A use, pay a fine of $1,000 on the DUI charge and a one-year license suspension, pay court costs, which average about $1,000, pay a $50 per month supervision fee while on parole and probation, and render a total of 225 hours community service when released on parole.Poniktera is currently an inmate in the Lehigh County prison on a parole violation and is awaiting resentencing.
