Lehighton man found guilty of indecent assault gets jail time

A Carbon County man, who was found guilty by a jury of four counts of indecent assault, was sentenced Monday afternoon to a county prison term.

Joseph J. Kulp III, 41, of Lehighton, was sentenced by Judge Steven R. Serfass to a total term of one day less 12 to one day less 24 months on the four counts. The jail term will be followed by one year of probation. On March 7 a jury panel found Kulp guilty of the four counts of indecent assault. Serfass found him guilty of two counts of harassment as summary offenses.Kulp was arrested by Lehighton police for grabbing the behind of a then-14-year-old female on two separate occasions. He was charged for an incident on July 20, 2010, and for the second incident which occurred sometime between May and August 2011.Kulp was not arrested until two years after the first incident. The first incident occurred while the girl was leaving a church in Lehighton. The second incident occurred along a street not far from the church. In both instances the girl told the youth pastor of the church about the incident, but he apparently did not report it to anyone. The girl told prosecutors that Kulp approached her inside the church at a youth group meeting and told her that her behind "looked good." He made the same remark just before the second grabbing incident, the girl said.Kulp admitted making the remark but denied ever touching the girl.Kulp was found guilty of two counts each of indecent assault without consent of the other, and indecent assault of a person less than 16.Kulp, however, will not be spending any more time in prison for the charges because he has been in prison for 235 days on the one set of charges, and credit for the same amount on the second set, meaning his minimum term is completed. He will not be released from prison, as he must first find a residence approved by the adult probation office. He has been in jail because his bail on the charges was revoked for violating a condition of his release.Serfass also ordered Kulp to get both a drug and alcohol and mental health evaluations and follow any recommendations for treatment, and have no contact with the victim or her family.Earlier this month Serfass conducted a hearing under Megan's Law to determine if Kulp was a sexually violent predator as provided in the law. An evaluation by the state sexual assessment board found he was a sexually violent predator. Serfass affirmed the board's finding.Kulp told Serfass, "I'm, sorry for what happened." Kulp was arrested in Lehigh County for a similar incident and pleaded guilty to the charges. The case was prosecuted by Assistant District Attorney Michael S. Greek. Public Defender Paul Levy represented Kulp.
