Schaffer, the suit alleges, was contracted by the bank to maintain and remove snow from the sidewalks.Negligence is alleged against the defendants and sought damages not in excess of $50,000 plus interest and costs.Suit over fireRobert and Corina Kugler, 203 Birchwood Drive, Lehighton, filed a civil complaint against Steven Weninger, individually and doing business as Safe & Warm Chimney Service, 49 Mountain View Drive, Tannersville.The suit states at the time relevant Weninger was engaged in the business of installing, servicing, cleaning, and inspecting fireplaces and chimneys, including the fireplace, and all parts and components.On Jan. 24, 2013, a fire erupted at the plaintiffs' property and it is alleged the fire was caused by the failure of Weninger to properly and safely install the fireplace insert into the existing fire box, failing to adequately clean the creosote from the chimney, and failing to remedy obvious code and other deficiencies in the fireplace.Allegations include that the defendant was asked if the fireplace was safe and that after the fire the defendant admitted that he knew the fireplace was dangerous.Negligence is alleged against the defendant and sought are damages in excess of $50,00 plus costs, delay damages, treble damages, and punitive damages, on each of two counts.
