Schuylkill County court rulings on drug cases

Schuylkill County President Judge William Baldwin has sentenced a Tamaqua man to probation in two drug-related cases.

Joshua McArdle, 23, was sentenced to one year of probation on charges of possession of a controlled substance by a person not registered. He also must serve another one year of probation on a use/possession of drug paraphernalia charge, but at the same time.The charges were filed on July 10, 2013, by Tamaqua police.In the other case, McArdle must serve 30 days of probation on charges of possession of a small amount of marijuana. He was also sentenced to serve 11 months of probation on the charge of possession of drug paraphernalia, to be served after he serves the one-year of probation on the first set of charges.The charges were filed on Feb. 21, 2013, by Tamaqua police.In another matter, Baldwin accepted a motion by Eugene Dacey, 39, of Nesquehoning, to withdraw his guilty plea to driving under the influence.Dacey will plead guilty.A pre-sentence investigation will be done before Baldwin sentences Dacey.He was charged on Aug. 25, 2012, by Rush Township police with driving under the influence with a high rate of alcohol. His blood alcohol content was between 0.10 and 0.16, according to court documents. The level of alcohol deemed to trigger impairment is 0.08.It was Dacey's second DUI offense.
