JT man pleads guilty in six retail thefts

A Carbon County man entered guilty pleas in six pending cases. He was among a total of 18 defendants to enter a guilty plea Tuesday in the county court before Judge Steven R. Serfass.

Retail theftsJustin Jacobacci, 31, of Jim Thorpe, pleaded to two counts of retail theft, and one count each of criminal conspiracy-retail theft, theft, and possession of drug paraphernalia.He admitted to retail theft incidents at the Walmart store in Mahoning Township that occurred on Sept. 20, 2012, and May 7 and June 16, of this year. He also admitted to a retail theft incident at Boyer's Market in Lansford on Aug. 20, 2012. He pleaded to a theft incident at a beer distributor in Summit Hill on July 26, 2012. The drug charge stems from a incident on July 23, 2012, along North St., in Jim Thorpe.Jacobacci told Serfass he stole to supply a drug habit.Serfass sentenced him to serve six to one day less 24 months in prison followed by two and a half years of probation.He was also ordered to render a total of 325 hours of community service when released from jail, make total restitution of $90.24 (most of the items taken in all the thefts were recovered), supply a DNA sample, and get a drug and alcohol evaluation and follow any recommendation for treatment.He was given credit for 149 days spent in jail on the charges.It was noted Jacobacci had detainers filed against him for pending charges in Lehigh and Schuylkill counties.Other pleasOther defendants who entered guilty pleas included:Kyle M. Hoppes, 25, of Tamaqua, pleaded to two counts of receiving stolen property. He admitted his part in the theft of jewelry from his father, Keith Hoppes, and then selling the items at a pawn shop in Lehighton. The incident occurred on or about Aug. 6. The theft occurred in West Penn Township, Schuylkill County.Serfass placed him on probation for a total of 24 months and ordered him to get a D&A evaluation, render 200 hours of community service, and make total restitution to his father and the pawn shop of $4,282.Nicole Marie Borger-Smith, 33, of Jim Thorpe, pleaded to one count each of unsworn falsification to authorities and cruelty to animals.She was arrested for an incident on Aug. 16, 2012, when state police at Lehighton responded to a report of a dog not being cared for at a residence along SR903. Troopers found a dog in need of food and water and traced ownership to Borger-Smith. When she was initially confronted by police she denied the dog was hers.On the unsworn count she was placed on probation for 24 months and ordered to render 100 hours of community service, get a mental health evaluation, and is not permitted to have a dog during the period.On the cruelty charge she was fined $300.Kayla Marie Kirkendall, 20, of Lehighton, pleaded to one count of criminal use of a communication device. Various drug counts were dropped in a plea bargain.She was arrested by agents of the state Attorney General's office for an incident on July 23 in the area of 92 E. Bridge St., Lehighton. She sold heroin to a confidential informant.Serfass placed her on probation for 48 months and ordered her to render 200 hours of community service, get a D&A evaluation, zero tolerance on D&A use, and supply a DNA sample.Robin Anne Geiger, 52, of Easton, pleaded to one count of criminal conspiracy-delivery of a controlled substance.She was arrested by agents of the state Attorney General's office for her part in the sale of prescription medication to a CI on May 7 along Blakeslee Blvd., in Lehighton.Serfass placed her on probation for 36 months and ordered her to render 150 hours of community service, get a D&A evaluation, and supply a DNA sample.Michael Stephen Karpinski, 35, of Red Lion, York County, pleaded to one count of criminal trespass as a felony.He was charged by Jim Thorpe police with entering a home at 576 Lentz Trail on Sept. 6. He was caught in the act by borough police. The home was unoccupied at the time.The owner of the home, Richard Gehring, told Serfass the house has been broken into on numerous occasions with various items being removed including copper piping, a radiator from a car parked in a garage attached to the home, and household items.Serfass sentenced him to time served (75 days) to one day less 24 months in prison. He was ordered to pay restitution of $480, render 100 hours of community service, and supply a DNA sample.Jamie Bartholomew, 31, of Palmerton, pleaded to one count of simple assault. She was arrested for an incident on Oct. 15 at 654 Franklin Avenue by Palmerton police. She assaulted Eliza Lesko, police said.Serfass deferred sentencing until proper restitution is determined.Sarah Yusella, 25, of Coaldale, pleaded to one count of receiving stolen property. She was arrested by Summit Hill police for taking jewelry from the home of Mary Yusella on June 13.She admitted to a drug addiction problem but said she is getting help for it.Serfass placed her on probation for 24 months and ordered her to render 100 hours of community service, get a mental health evaluation, and make total restitution of $1,180, which is her share as there is a co-defendant in the case.Shelly L. Filer, 42, of Palmerton, pleaded to one count of retail theft. She was arrested by Mahoning Township police for an incident at the Walmart store on May 24 in which she attempted to leave the store with a cart loaded with various items valued at over $1,000.Sentencing was deferred.Roberto Rodriguez Otero, 19, of Allentown, pleaded to one count of criminal conspiracy-retail theft. He was arrested by Mahoning Township police for an incident at the Walmart store on Sept. 5, 2012.Serfass placed him on probation for 24 months and ordered he to render 100 hours of community service, and make restitution of $798.34, which is his share as there is a co-defendant in the case.Jessica Vogel, 40, of Shenandoah, pleaded to one count of unsworn falsification to authorities. She was arrested on June 22 by Lehighton police for an incident in the lower park.She was placed on probation for a year and ordered to render 50 hours of community service.Maria McKittrick, 48, of Palmerton, pleaded to one count of possession of a small amount of marijuana. She was arrested on July 19 outside the Rusty Nail Bar by Palmerton police. Police responded to a reported disturbance which resulted in her arrest.Serfass imposed a fine of $250.DUI casesThe following defendants entered guilty pleas to driving under the influence charges.Tyrone Lionel Allen, 51, of Slatington, was arrested on March 2, along Pawnee Trail, in Penn Forest Township by state police at Lehighton. Given a test, the result was .17BAC.Sentencing was deferred.Stephen M. Holmes, 28, of Palmerton, was arrested on June 11 along Fireline Road, in Lower Towamensing Township, by state police at Lehighton. Given a test, the result was .09BAC.Serfass sentenced him to serve five days to six months in jail, a fine of $300, one year license suspension, get a D&A evaluation, and render 25 hours of community service.He will begin the jail term on Nov. 22 at 5 p.m. and serve it on consecutive weekends of three days and then two days.Tisha L. Staehle, 34, of Lansford, was arrested on Oct. 9, 2011, along SR443 by Mahoning Township police. Given a test, the result was .12BAC. She was previously placed in the county's Accelerated Rehabilitation Disposition probation program but was revoked from it.Serfass placed her on probation for six months, a fine of $300, get a D&A evaluation, and render 25 hours of community service.Richard Fedrigo, 50, of Jim Thorpe, was arrested on July 8 along Parker Trail, in Penn Forest Township by state police at Fern Ridge. Given a test, the result was .19BAC.Serfass sentenced him to serve five days to six months in jail, a fine of $300, one year license suspension, get a D&A evaluation, and render 25 hours of community service.He was given credit for seven days already spent in jail on the charge and was paroled.Matthew J. Nicosia, 46, of Jim Thorpe, was arrested on Dec. 15, 2012, along SR903 by Jim Thorpe police after being involved in an accident. He refused a test and will lose his license for a year for the refusal.Serfass sentenced him to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension, get a D&A evaluation, and render 25 hours of community service.On a summary office of driving without a license he was fined $200.He will begin the jail term at noon on Nov. 22.Eric Martin Schlier, 43, of Lehighton, was arrested on June 1 along SR209 in Franklin Township by state police at Lehighton. Given a test, the result was .07BAC.Serfass sentenced him to serve five days to six months in jail, a fine of $300, one-.year license suspension, get a D&A evaluation, and render 25 hours of community service.He will serve the jail term on consecutive weekends beginning Nov. 29 at 6 p.m. and serve two and then three days.Each defendant sentenced must also pay court costs, which average close to $1,000, and pay a $50 per month supervision fee while on probation or parole.
