Carbon County Court Police, hospital incidents result in prison sentence

A Carbon County man who assaulted a police officer and caused damages to a county hospital pleaded guilty Thursday and was sentenced to a state prison term.

He was one of 13 defendants in pending cases to enter a plea before President Judge Roger N. Nanovic II.Lehighton incidentShane Dease, 39, of Palmerton, pleaded to one count each of simple assault and criminal mischief for an incident at the Blue Mountain Health System's Gnaden Huetten Campus, Lehighton.On March 29 borough police were dispatched to the hospital for a report of a person out of control. On scene officers found Dease seated in his vehicle outside the emergency entrance.Police learned that Dease was there for commitment to the mental health unit and became unruly. During a disturbance inside the ER, he damaged a computer.Outside he refused to leave the vehicle and be admitted to the hospital. When police attempted to get him out of the vehicle he struggled with the officers.Dease was recently sentenced in Lehigh County court to serve 27 to 84 months in a state correctional institution on unrelated charges. It was also noted that Dease is facing aggravated assault and related counts for an incident at the office of District Judge Edward Lewis, of Jim Thorpe, where he assaulted a police officer.Dease admitted to a long-term mental health problem.Nanovic sentenced him on the assault count to serve six to 18 months in a state prison and the same term on the mischief count, with the terms running concurrently. Nanovic also gave Dease a break by running the terms concurrent with the Lehigh County sentence.Dease was also ordered to get a mental health evaluation and make restitution to the hospital for the damaged computer of $1,000.Other pleasOther defendants who entered pleas included:Jennifer Gongora, 28, of Palmerton, pleaded to one count each of DUI and endangering the welfare of a child.She was arrested on June 6 in the parking lot of the Rite Aid store in Palmerton, where police had responded to a report of a theft. Given a test, the result showed the presence of a controlled substance. At the time of the stop police found a eight-year-old child in the car. Also found was heroin.On the endangering charge Nanovic sentenced her to serve three to 12 months in prison followed by two years of probation. On the DUI charge she was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, make total restitution of $786.27, get a D&A evaluation, and zero tolerance on DUA use. On a driving under suspension count she was fined $200.The jail terms run consecutively and began immediately.Sherri Ann Simmons, 46, formerly of Lehighton and now residing in Harrisburg, pleaded to one count each of driving under the influence (DUI) and driving under suspension-DUI related.She was arrested on Nov. 1, 2012, along Canal St., by Franklin Township police. Police responded to a hit and run report. Police determined that Simmons was driving a pickup truck that struck a utility pole in the area of the Boatyard tavern, and fled the scene.Defense Attorney Mark Combi told Nanovic Simmons had a alcohol abuse problem but has addressed it. She entered the Salvation Army's inpatient program in Harrisburg in February where she successfully completed a six months stay. She is currently in a after-care program and is working in Harrisburg, where she has now decided to stay and live.On the DUI count Nanovic sentenced her to serve 90 days to five years in jail, a fine of $1,500, license suspended for 18 months, get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment, and zero tolerance for D&A use.On the suspension count she was sentenced to serve 90 days in jail and a $500 fine. There will be another year suspension. The terms run concurrently. Nanovic also gave her credit for the six months spent in the inpatient program and immediately paroled her.Bambi Lynn Taschler, 35, of Lehighton, pleaded to one count of indecent exposure.On May 26 Palmerton police responded to the Family Dollar Store, along Delaware Avenue, to a report of a shoplifter. On scene officers were met by store personnel who identified Taschler as the one involved.The employees said Taschler left the store and went out side where she exposed herself by pulling down her pants and urinating in a bush. Taschler said she wasn't wearing pants, but had a dress on, but admitted to the offense.In a plea bargain, a retail theft count was dropped.Nanovic placed her on probation for a year and ordered her to get both mental health and D&A evaluations, zero tolerance on D&A use, and make restitution to the store for $36.86. The restitution has already been paid, it was noted.Eric Matthew Williams, 41, of Lehighton, pleaded to one count each of receiving stolen property and criminal mischief.He was arrested by state police at Lehighton for taking a lawn mower from the property of Helene Braren, at 1105 Summer Mountain Road, in Towamensing Township, on July 17.Williams said he thought the mower belonged to another person who owed him money. Nanovic said that was no way to collect a debt.Nanovic sentenced him to serve 45 days to one year in jail followed by one year of probation, on the receiving charge. On the mischief count he was fined $300.He begins the jail term at 10 a.m. on Monday, Oct. 21.Scott David Kibler, 43, of Lehighton, pleaded to one count each of criminal conspiracy-receiving stolen property, and conspiracy-criminal mischief.He was arrested for the same incident as Williams.Sentencing was deferred.Jeremy Lee Pauley, 31, of Schuylkill Haven, pleaded to one count of theft by deception.He was arrested by Lehighton police on a complaint received from Gina Zarcone, on Nov. 27, 2012.. Zarcone told police she met Pauley in a bar and he told her he was a tattoo artist. She said Pauley agreed to make her his apprentice and would take her to Europe to work. She said she gave him $2,600 in cash for the trip, but then never heard from him again. He admitted taking money and said he had repaid all but $1,000, which he would pay following the court proceeding.Nanovic placed him on probation for a year and ordered he pay the $1,000 to the collection bureau immediately after the proceeding.Justin P. Mooney, 24, of Lehighton, pleaded to one count each of theft and criminal mischief.He was arrested by Mahoning Township police for entering the property of Scott and Cynthia Ritter and removing a 60-inch television set and a jewelry box. The victims are is aunt and uncle.He was previously placed in the county's Accelerated Rehabilitation Disposition probation program for first time offenders but was revoked for violating conditions.Nanovic placed him on probation for two years and ordered he get a D&A evaluation and make restitution of $627.10, his share, as there are co-defendants in the case. On the mischief charge he was fined $500.Total restitution was over $2,100.Michael Lower, 36, of Lehighton, pleaded to one count each of DUI and possession of drug paraphernalia.He was arrested on March 7, 2009, along E. Patterson St., by Lansford police. Given a test, the result was .16BAC.A first offense for DUI, he was placed on probation for six months and ordered to pay a fine of $300, get a D&A evaluation, and zero tolerance on D&A use. On the drug count he was placed on probation for a year consecutive to the DUI charge.Johnie Zeke Derose, 29, of Tunkhannock, Monroe County, pleaded to one count each of possession of a small amount of marijuana and possession of drug paraphernalia.He was arrested on July 24 by state police at Pocono following a traffic stop along the turnpike in Penn Forest Township.On the paraphernalia charge he was placed on probation for six months and ordered to get a D&A evaluation. On the small amount charge he was fined $500.Higgins Reyes, 26, of Brooklyn, N.Y., and formerly of Palmerton, pleaded to one count of DUI. He was arrested on Oct. 12, 2011, along Mauch Chunk Rd., in Palmerton, by state police at Lehighton. Given a test, the result was .09BAC.He was previously placed in the ARD program but was revoked.Nanovic placed him on probation for six months, pay a fine of $300, and get a D&A evaluation.Ryan M. Currie, 27, of Lower Gwynedd, Montgomery County, pleaded to one count of DUI.He was arrested on June 23 along SR248 at Bowmanstown, by state police at Lehighton. Given a test, the result was .10BAC.Nanovic sentenced him to serve five days to six months in jail, a fine of $1,500, one year license suspension, get a D&A evaluation, and render 50 hours of community service.He began the jail term immediately.Jay Michael Miller, 20, of Lehighton, pleaded to one count of simple assault.He was arrested on Aug. 13 by state police at Lehighton when troopers responded to 232 Hemlock St., Towamensing Township, for a reported domestic dispute. Miller's girlfriend at the time reported she was assaulted by him during a dispute.Nanovic placed him on probation for a year and ordered he had no contact with Graham.Each defendant sentenced must pay court costs, which average about $1,000, and pay a $50 per month supervision fee while on probation or parole.
