Luzerne man facing charges
A Luzerne County man is facing charges for an incident in Nesquehoning.
Borough police said John Joseph Boettcher, 22, of 272 W. County Road, Sugarloaf, has been charged with fleeing or attempting to elude police, unlawful possession of a controlled substance-marijuana, and two counts of summary offenses of driving a vehicle at an (un) safe speed. The charges were filed by Officer Steven Homanko.According to the affidavit of probable cause, on Saturday, July 27, about 7:49 p.m. Homanko was along SR93 monitoring speed, when he clocked a vehicle going 76 miles-per-hour in a posted 55 zone. The car was a silver Nissan Altima.While attempting to catch up to the vehicle, the other driver increased his speed. The vehicle continued to pull away despite the lights and siren activated on Homanko's vehicle.The speeds became very high at times, Homanko notes in his report, and the chase continued for about five miles into Packer Township. Speeds were recorded at 105 mph in the area of SR93 and Brenkman Drive. The driver eventually pulled over and exited his vehicle. He appeared very dazed and hyper, Homanko noted, and began to state that he needs a break, and he didn't mean to do this. At this point Officer Dane O'Brien of Nesquehoning arrived on scene.The driver was then identified as Boettcher. His eyes were glassy and constricted and he smelled of the faint odor of alcohol. Observed in the vehicle was a small amount of marijuana. Homanko's report indicated O'Brien told Boettcher seven times to stop moving around and to keep his hands out of his pockets, but the suspect did not comply.Boettcher was then transported to St. Luke's Hospital, Coaldale, and later released to his grandmother.Police said on Saturday, Sept. 14, Boettcher was arrested at his residence in Sugarloaf Township and arraigned before on-call District Judge Joseph Homanko, of Weatherly, and lodged in the county prison after failing to post bail.
