Parole/probation revocation hearings held

Carbon County judges conducted parole/probation revocation hearings recently on petitions filed by the adult probation office.

The petitions were filed by the probation office against defendants who violated the terms of their parole or probation.Damian Eidem, 26, of Lehighton, had his parole revoked on a simple assault charge because he violated the conditions of his release.He was resentenced by Judge Steven R. Serfass to serve four months back-time in the county prison effective Jan. 2, 2014, at 9 a.m. and must obtain both a drug and alcohol and mental health evaluations and follow all recommendations of treatment. However, if he completes the evaluations before Jan. 2, the prison sentence will be vacated.Jamie Schembri, 35, of Albrightsville, had his probation revoked on a charges of persistent disorderly conduct and criminal mischief.He was resentenced by Serfass to serve three to six months in prison beginning Jan. 2, 2014, at 9 a.m. However, if he completes 10 hours of community service before that date the prison sentence will be vacated.Amanda Messinger, 23, of Lehighton, had her parole revoked on charge of simple assault.She was resentenced by Serfass to serve three months back-time in the county prison beginning Jan. 2, 2014 at 9 a.m. If she pays $450 in court costs before the Jan. 2 date then the prison term will be vacated.Kelly Yerger, 41, of Nesquehoning, had her parole revoked on simple assault count. A petition filed by probation officer Clifford Eckhart indicated she violated her conditions by possession of a controlled substance on July 4, and that violated the zero tolerance provision.She was resentenced by Serfass to serve five months in the county prison with credit for 62 days, effective Sept. 3.Ricky Hunsicker Jr., 28, of Summit Hill, had his probation revoked in two cases on charges of theft and possession of drug paraphernalia. Eckhart said he violated the conditions by possessing a controlled substance on July 5 which violated the zero tolerance provision.He was resentenced by Serfass to serve three to 10 months in the county prison on each case with the terms to run concurrently. He was given credit for 57 days already spent in jail on the charges.David Gross, 28, of Summit Hill, has his probation revoked on a driving under the influence (DUI) charge on a petition filed by Eckhart. He violated the conditions of not completing the highway safety course, failed to attend and complete drug and alcohol counseling, and failed to perform 25 hours of community service.He was resentenced by Serfass to serve three to six months in prison beginning Oct. 4 at 9 a.m. However, if he provides proof of completion of the highway safety program and D&A treatment by Oct. 4 the prison term is vacated.Jonathan Zerby, 21, of Palmerton, had his parole revoked on burglary and related counts on petition filed by probation officer Kimberly Cooper. He violated the conditions by testing positive for opiates, admitted taking non-prescribed morphine pill, failed to submit to a urine screen which violated the zero tolerance provision, and admitted drinking alcohol while on supervision.Judge Joseph J. Matika resentenced him to serve 90 days in the county prison effective July 8.Melissa Pankevitch, 30, of Palmerton, had her parole revoked on a endangering the welfare of a child charge on a petition filed by Cooper. She violated the conditions by failing to report to the probation office on July 5 and 8, tested positive for amphetamine and suboxone, failed to submit to a urine screen on July 5, which violated the zero tolerance provision, and her D&A and mental health status unknown.President Judge Roger N. Nanovic II resentenced her to serve out her maximum date in the county prison which ran to Sept. 2.Elizabeth Malarkey, 22, of Palmerton, had her parole/probation revoked on charges of receiving stolen property and theft. She violated the conditions by testing positive for opiates, which violated the zero tolerance provision, and she associated with other individuals on supervision.Matika resentenced her to serve nine to 24 months in a state correctional institution with credit for 14 days.Kevin Joseph Tansley, 26, of Palmerton, had his bail revoked on petition filed by Cooper. He violated the conditions of his bail by failing to report to the probation office on Aug. 16, failed to submit to a urine screen on Aug. 7, and did not attend AA meetings as directed.Nanovic reset bail at $5,000 straight cash. He failed to post the bail and was remanded to the county prison.The court order also states if he posts bail upon is release from jail must immediately report to the probation office to be entered in the pretrial services program, must attend AA meetings and provide bi-weekly proof of attendance, and is $500 previously posted bail is forfeited.Louis Zielinski, 22, of Lehighton, had is probation/parole revoked on drug possession and disorderly conduct charges on a petition filed by Cooper. He violated the conditions by failing to report to his probation officer, failed to submit to a urine screen in April, tested positive for opiates, and has not engaged in D&A treatment.Matika resentenced him to serve 49 days to 98 days in prison effective June 13. The order states he must serve the full 98 days. He is eligible for work release.David Rowe, 53, of Palmerton, had his parole revoked on a charge of simple assault on petition filed by Cooper. He violated the conditions by testing positive for alcohol which violated the zero tolerance provision.Serfass resentenced him to serve 30 days in prison effective July 25.Robert Fisher, 30, of Palmerton, had his parole revoked on charges of fleeing or eluding police on petition filed by Cooper.Matika resentenced him to serve four months back-time effective July 21.Todd Yanchek, 42, of Slatington, had his probation revoked on a charge of deceptive business practices filed by probation officer Joseph J. Berke. He violated the condition that he was charged with theft by deception, receiving stolen property, and deceptive/fraudulent business practices, filed by Walnutport police.Matika resentenced him to serve a total of 11 to 22 months in the county prison effective Aug. 1 He was granted work release.
