Two inmates sentenced for assaults at state prison

Two inmates in the state correctional facility in Ryan Township pleaded guilty to altercations with other prisoners and were sentenced in Schuylkill County court.

Derick Devaughn Tomlin, 38, pleaded guilty to a simple assault and recklessly endangering charges and was sentenced by President Judge William E.Baldwin to serve 24 to 48 months in the state prison. He admitted assaulting Sandford Edwards, a cell mate, who suffered head injuries.The sentence is to begin at the expiration of a sentence he is now serving.Ryan Joseph Menkins, 28, who pleaded guilty to assaulting, Edward Martin, an inmate, in the gym corridor on March 28, 2012, was sentenced by Baldwin to serve one to two years in the state facility with the sentence to run concurrent to the sentence now serving.RevocationsZachary Jay Hickey, 21, Pottsville, had his probation revoked by Judge James P. Goodman and he was re-sentenced on the charge of possession of drug paraphernalia to serve three to six months in the county prison with credit for servng 26 days. He must undergo a drug and alcohol evaluation and is eligible to participate in the work release program.Hickey pleaded guilty last April after being removed from the Accelerated Rehabilitative Disposition (ARD) P probation program which is reserved for first offenders.Breanne Newton, 30, Pottsville, had his probation revoked by Judge Cyrus Palmer Dolbin and he was re-sentenced to serve six to 18 months in the county prison on a charge of criminal conspiracy to defraud a bank. He received credit for serving 12 days in prison. He had pleaded guilty to the charge on July 25, 2012, and was placed on probation.Elizabeth Ann Norris, 41, Palo Alto, had her probation revoked by President Judge William E. Baldwin and was re-sentenced to a charge of endangering the welfare of a child to serve 24 months on probation to begin at the expiration of a 35 months probation sentence now serving. She had pleaded guilty to the charge on Feb. 22, 2012.Elizabeth Ann Norris, 41, Palo Alto, had her parole revoked by Baldwin and she was recommitted to the county prison to serve out her sentence and the court will not consider an application for parole until four months had been served. On a second count of simple assault she will have to serve 24 months probation which begins upon completion of her first sentence for simple assault. She had pleaded guilty to the charge on Feb. 22, 2012.William J. Smith, 31, Ashland, had his probation revoked by Baldwin and he was re-sentenced on a charge of possession of drug paraphernalia to serve six to 12 months in the county prison. He had pleaded guilty to the charge on Feb. 22, 2012, and was placed on probation. On another charge of escaping from custody of a police office his 344 days of liberty were disallowed and he was remanded to prison to serve the balance of his sentence. No consideration for parole will be allowed before Feb. 16, 2014.Angel Junior Delrio, 24, Ashland, had his parole revoked by Baldwin and his 174 days of liberty disallowed and added to his maximum sentence. He received credit for serving 78 days in the county prison. He had pleaded guilty last Feb. 20 to the charge of driving under the influence (DUI) of alcohol and after serving 72 hours in prison was released on parole.Charles Michael Koncsler, 47, Ringtown, was removed from the Intermediate Punishment Program (IPP) by Judge John E. Domalakes and was re-sentenced to serve 50 days to six months in the county prison with credit for time served and is eligible to apply for parole. He pleaded guilty to DUI of alcohol last May 13 and was admitted into the program.
