Conditional approval given for Eagle Rock subdivisions

By a split vote Eagle Rock Resorts Company received a conditional approval from the Schuylkill County Planning Board for its subdivision plan for a recreational site in action taken at its monthly meeting held Wednesday evening at the courthouse in Pottsville. There were two votes taken on the proposal.

The first proposal was to reject the plan which was defeated by a 5 to 3 vote and after a lengthy discussion.The second vote was taken to grant the subdivider 90 days to complete its plan for submission for final approval which passed by a 5 to 3 vote. There was a condition attached to the second motion to warn the developer that development should not be undertaken without first receiving approval from the board.To complete the plan the board stated since this was a re-submission of the AW Subdivision in East Union Township the plan calls for eliminating proposed lots and constructing a recreation area which already exists the board pointed out.The board ruled a revised National Pollutant Discharge Elimination System (NPDES) permit and Erosion and Sedimentation plan may need to be submitted to the Schuylkill County Conservator District and Department of Environmental Protection (DEP) before the final plan is approved.The board also requests that an adequate legend be included in the final plan to indicate clearly which features exist and which are proposed and to show all water and sewer lines, electric lines, including the size location and invert elevations of each serving the recreation area, also, to show road details and pedestrian paths to each individual recreation area (macadam and gravel) and to show the detail of the fence surrounding a swimming pool. The board gave the developer 90 days to complete its plan and will act on it at its November meeting.Conditional approval were also granted to seven other subdivision plans and given 90 days to complete the plans. They were:Ernest L. Klinger Jr., who seeks to annex 28.775 acres located partially in Barry and Hegins townships, needs to update his deed showing the annexation of one parcel to another and that neither parcel can be sold or developed separately.A second plan to subdivide 5.789 acres in Washington Township for a single family residence needs approval from DEP for the proposed installation of an on-lot septic system before final approval is received.Alfred J. Matuk, Union Township, seeks to subdivide 15.83 acres into three lots for a single family residential plus a residue needs approval of a sewage facilities planning module from the Sewage Enforcement Officer, an easement agreement from an adjoining property, an erosion and sedimentation control plan and an NPDES permit.The Sensenig Tract Plan, Washington Township, which seeks to subdivide 93.37 acres for an animal husbandry site, was granted waivers to have the riser of all basins be constructed of precast concrete or poured in place concrete, install a fence suitable and vegetation screen around the basins and install a stormwater pipe with a minimum diameter of 15 inches and pipe material before final approval is received.The plan of Orval T. Shoup, Linda Shoup, and Brenda White, Union Township, seeks to subdivide 54 acres into one lot and is required to draw location map at a scale of one inch equal to 2,000 feet before final approval is received.Janet Antz, Union Township, seeking to adjust new boundary line and annexation of 53.973 acres and 18.578 acres shall submit a new deed before final approval is received.Rangers Hose Company, Girardville, seeks to annex a lot 0.361 of an acre and is required to submit a new deeds describing the metes and bounds for the property including the new area it seeks to annex.
