Nine first time offenders in the criminal justice system were placed in Carbon County's Accelerated Rehabilitation Disposition (ARD) probation program on Tuesday.

If a person successfully completes all conditions of the program their record is wiped clean. However, if they fail to complete it, or are revoked from it, then they will face trial on all pending charges. A person does not admit guilt in entering the program.Judge Steven R. Serfass placed all for a year, unless otherwise noted.John H. Bennett, 35, of Lehighton, was placed on a driving under the influence (DUI) charge. He was arrested on Nov. 24, 2012, along Mahoning St., in Lehighton, by state police at Lehighton. Given a test, the result was .09BAC.He was assessed $450 for the cost of the program, and ordered to get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment, and render 50 hours of community service.Samantha Marian Everett, 23, of Lehighton, was placed on a DUI charge. She was arrested on Feb. 23 along North St. by Lehighton police. Given a test, the result was .12BAC.She was assessed $500, license suspended for 30 days, and render 50 hours of community service.Joshua M. Fabiani, 33, of Jim Thorpe, was placed on a DUI charge. He was arrested on March 23 along Lentz Trail by Jim Thorpe police. Given a test, the result showed the presence of a controlled substance.He was assessed $600, license suspended for 60 days, get a D&A evaluation, and render 50 hours of community service.Thomas Martin Fretz, 23, of Blakeslee, was placed on a retail theft charge. He was arrested by Mahoning Township police on April 3 for an incident at the AT&T store in which Iphones were taken.He was assessed $450, and ordered to render 50 hours of community service, and make restitution in an amount to be determined by the adult probation department.Lynn A. Gogle, 41, of Bowmanstown, was placed on a DUI charge. She was arrested on May 4, 2012, along Ninth St., by Lehighton police.She was placed for 18 months, assessed $600, get a D&A evaluation, zero tolerance for D&A use, license suspended for 60 days, and render 75 hours of community service.Joy Koller, 31, of Hellertown, was placed on a DUI charge. She was arrested on Jan. 31 along Bridge St., by Lehighton police. Given a test, the result was .20BAC.She was placed for 24 months, assessed $550, get a D&A evaluation, license suspended for 60 days, render 100 hours of community service, and pay total restitution of $6,795 for damages resulting from an accident.Zachery Maurer, 28, of Nesquehoning, was placed on a DUI charge. He was arrested on Feb. 24 along Mauch Chunk St., by Mahoning Township police. Given a test, the result was .17BAC.He was assessed $550, get a D&A evaluation, license suspended for 60 days, and render 50 hours of community service.Shelby L. Zimmerman, 26, of Lehighton, was placed on a DUI charge. He was arrested on Feb. 24 along Mauch Chunk St., by Mahoning Township police. She was arrested on Nov. 15, 2012, along Pohopoco Drive, in Towamensing Township, by state police at Lehighton. Given a test, the result showed the presence of a controlled substance.She was assessed $600, license suspended for 90 days, and render 50 hours of community service.Each defendant must also pay court costs, which average about $1,000, and pay a $50 per month supervision fee while in the program.
