Thorpe man facing counts in Lansford

Terry Phillips, 38, of 21 Lentz Trail, Jim Thorpe, faces charges from an incident which took place on May 15 on East Abbott Street, Lansford. Phillips is charged with burglary and criminal trespass.

According to an affidavit of probable cause, here's what happened:At about 7 p.m. Officer Joshua Tom and Sgt. Jack Soberick were on patrol about 20 minutes before, Tom had seen Phillips walking out of a basement door at 26 E. Abbott St., carrying what appeared to the base of a kitchen cabinet, and put it down in front of the house. He then went back into the house through the same basement door.A report of a possible burglary at that address came through at about 7 p.m. Upon arriving Soberick spoke with Ed Gurka, who said he had heard someone in the vacant house next door to his. Police didn't see anyone around the house but checked the house. They entered through an unlocked basement door facing East Abbott Street and checked all three floors without seeing anyone.They removed a full sheet of plywood that had been nailed over a doorway, but now hung askew. The plywood had been used to block off an enclosed porch from the rest of the house. Police entered the porch, and noticed the rear door, facing Water Street, was not locked.They opened the door and saw fresh tracks leading through the yard to the street above where they saw Phillips standing, looking down at them. Phillips was wearing the same clothing as when Tom had seen him earlier, exiting and re-entering the house.Tom saw Phillips talking with several females, and heard one of them say "I will not lie for you, Terry." However, Tom could not tell which female made the comment.Police yelled for Phillips to come talk them, which he did. While drinking a beer he had just begun saying, "I never left this street and you know that" to his sister. Tom asked Phillips why he was inside the house but Phillips said he had never left the block in front of his mother's house.Tom told Phillips he had watched him go in and out of the house.Phillips insisted he that he had not been anywhere near the house, and that Tom had not seen him.
