Five area residents among twelve to be sentenced

Five area residents were among 12 who were sentenced on criminal charges in Schuylkill County court.

Wayne Faillace, 43, of 325 Schuylkill Ave., Tamaqua, pleaded guilty to theft of personal property from the vehicle of Rodney Button, Tamaqua, and was given credit by Judge James P. Goodman of serving 133 days in the county prison and was released on parole for 12 months. He was ordered to pay $50 to the Criminal Justice Enhancement Account (CJEA), and make restitution of $62.54 to the victim. Faillace was cited by Tamaqua Chief Richard Weaver.Michael James Kirkland, 29, Pine Grove, pleaded guilty to possession of a controlled substance and drug paraphernalia and was given credit by Goodman for serving five days in the county prison and was released on parole for 12 months, pay $100 to Substance Abuse Education (SAE) fund, and $50 to CJEA fund. Kirkland was cited by Pottsville Cpl. Mark D. O'Toole.Each defendant must also pay a $50 per month supervision fee while on probation or parole.RevocationsCraig York, 28, of 216 Hunter St., Tamaqua, had his parole revoked by Judge Charles M. Miller and was re-sentenced to serve two to five years in a state correctional institution and must complete a sexual offender treatment program. He was found guilty by a jury in September 2009 of a charge of sexual abuse of children by possessing child pornography. This was his third revocation.Joshua Michael Dewire, 23, of 66 Holland St., Tamaqua R.D., had his probation revoked by Judge Cyrus Palmer Dolbin and was re-sentenced on a simple assault charge to serve six to 12 months in the county prison with credit for serving 129 days. He had pleaded guilty in April 2012 to assaulting a patron with a pool stick in the Tiki Bar, Tamaqua,Hubert W. Budd, 19, of 431 Glenwood Ave., Tamaqua, had his probation revoked by Miller and was re-sentenced to serve an additional 12 months on probation. He had pleaded guilty in June 2012 to possession of drug paraphernalia.Chad Belsak, 37, of 43 Ridge Lane, New Ringgold, had his parole revoked by Judge John E. Domalalkes and was remanded to the county prison to serve the balance of his sentence with 100 days of liberty disallowed. Belsak had pleaded guilty in May 2009 to manufacturing and possession of controlled substance. This was his second revocation .Brian Edward Bernotas, 37, Frackville, was removed by Dolbin from the Intermediate Punishment Program (IPP) and was re-sentenced to serve 18 months to three years in prison on three counts of criminal trespass on private properties and theft of personal properties. He had pleaded guilty to the charges last October and was placed on probation in the special program for 24 months but was found to have violated the terms fixed by court.Charles Jason Koncsler, 31, Shenandoah, had his probation revoked by Miller and was re-sentenced to serve one to two years in a state correctional facility and must obtain a drug and alcohol evaluation. He pleaded guilty in November 2010 to charges of retail theft and possession of a controlled substance and drug paraphernalia and was placed on probation.Andrew Lane Schmidt, Shenandoah, had his parole revoked by Miller and was remanded to the county prison to serve the balance of his sentence and receives no credit for 322 days liberty. He is eligible to re-apply for parole in 60 days. Schmidt pleaded guilty in June 2012 to terroristic threats, simple assault, and recklessly endangering another person.Shane Graydon Ditzler, 38, Myerstown, Lebanon County, had his probation revoked by Miller but escaped going to prison as the court gave him credit for serving 32 days and granted him immediate parole. Ditzler had pleaded guilty last October to forgery charges. He also must undergo a drug and alcohol evaluation.Tabitha Jane St. Pierre, 22, Frackville, had her parole revoked by Miller and she was remanded to the county prison to serve the balance of her sentence and 304 days of liberty were disallowed which extended her maximum date for release at Sept. 24, 2014. She also must complete a drug evaluation. St. Pierre was charged with giving false report to police of an assault charge. She can re-apply for parole in 90 days.
